The state of Kentucky is an excellent location to form your Limited Liability Company (LLC) for several reasons. It has some of the lowest entry and maintenance fees throughout the U.S., making it a highly cost-effective state. Furthermore, it provides a business-friendly operating environment with targeted incentives for small businesses.

After forming your LLC by getting your Articles of Organization approved by the Kentucky Secretary of State (SOS), you must register your business with the Kentucky Department of Revenue (DOR) before beginning operations. This registration allows the state to create the tax accounts your LLC needs to meet its state tax obligations.

In this guide, I’ve discussed everything you need to know about the Kentucky tax registration application process. You’ll learn how to complete your application online or by mail, the requirements and fees, and the dangers of trying to operate without registering.

Kentucky Tax Registration Application Overview

To enroll in the state’s tax system, every LLC conducting business in the state needs to file a Kentucky Tax Registration Application (Form 10A100(P)) with the DOR. This is free to file and registers your business for its required tax accounts once completed. Examples include the Kentucky Limited Liability Entity Tax (LLET) and the Sales and Use Tax.

Note: New Kentucky LLCs (domestic and foreign) must submit their registration 30 days before engaging in taxable activities in the state.

You must obtain your Employer Identification Number (EIN) before registering. You can read my guide on How To Obtain A Kentucky EIN if you haven’t got one yet.

Use the MyTaxes.ky.gov portal or download the Kentucky Tax Registration Application paper form to complete your registration. These are the typical processing times:

  • Online: 5 to 10 business days.
  • Mail-in: Up to 3 weeks.

Note: If you’re an out-of-state LLC, you can submit Form 41A800 “Corporation and Pass Through Entity Nexus Questionnaire to the DOR. This provides a determination on the nexus/applicability of the Commonwealth of Kentucky Corporation Income and/or LLETs.

Before doing the registration, you first need to have a MyTax Account. If you haven’t got one yet, don’t worry, I will guide you through how to obtain one, specifically below this section.

1. Access Your Form

a. Log In

To begin, navigate to the Kentucky MyTax page. Click “Log In Now” and log in with your MyTax account.

Click “Transactions” and “Submit Application.

Then, click “Register a New Business.

c. Informational Page

The next page should contain information regarding the tax accounts that you can register using the portal. Click “Next” and move to the next section.

2. Reason For Application Section

Choose “Open new business/Began activity in Kentucky” from the dropdown menu for “Select the reason for this application.”

  • Select “No” if you haven’t received correspondence from the Division of Registration.
  • Select “Yes” and enter your document number if you have.

Following this, choose “Limited Liability Company” as your business structure. After confirming your information, click “Save And Continue” to proceed.

3. Add Your Business Information

a. General Business Information

Enter the following information in the Business Information section:

  • Legal business name: Exactly as stated in your Articles of Organization.
  • DBA name: Only enter if you have a DBA name.
  • Start date of business activities in Kentucky: The date that your Articles of Organization were approved by the SOS.
  • EIN (FEIN): Enter your EIN number.

b. How Does Your Business Operate?

Next, choose how your business operates and confirm your industry:

  • Business operations: Home-based, Web-based, Office/Store-based, or Transient.
  • Business description: Provide a brief description of your business activities, including the services and products that you sell.
  • NAICS category, subcategory, and code: Use the NAICS Lookup website to find the classification that best describes your LLC.

c. Accounting And Tax Information

Provide your accounting and tax information:

  • Fiscal year ending: Pick the month that your financial year ends. If you choose December, your fiscal year will match your calendar year (January to December). Otherwise, your fiscal year can be any 12 months.
  • 52/53-week filer: Complete this if your fiscal year follows a 52–53 week schedule instead of ending on the last day of a month.
  • Accounting method: You can choose cash or accrual. Pick “Cash” if you want to report income when received and expenses when paid. Pick “Accrual” if you want to report income when earned and expenses when incurred.

You have 4 main options when choosing your federal tax classification:

  • Single-member LLCs: SMDE-individual sole proprietorships.
  • Multi-member LLCs: Partnerships.
  • Corporation or S corporation: If you have filed that tax election with the IRS.

4. SOS Information (Optional)

Provide information regarding your LLC’s state registration in the SOS Information section:

  • Kentucky Commonwealth Business Identifier (CBI): Enter your 10-digit CBI if your LLC has been assigned one. This identifies your business across the state agencies via the Kentucky Business One Stop Portal. New businesses do NOT normally need to fill in this section.
  • Kentucky SOS organization number: The number listed in your Articles of Organization. You can find this using the Kentucky Business Entity Search database.
  • Date of incorporation/Organization: State the date that your Articles of Organization formation documents were officially approved by the SOS. If your LLC is out-of-state, provide the original date that your documents were approved by your state agency.
  • State of incorporation/Organization: Choose “Kentucky” if your LLC is domestic. If you’re a foreign entity registered outside Kentucky, pick another state.
  • Out-of-state entities only: Provide your date of qualification. This is the date that your Certificate of Authority was approved by the Kentucky SOS.

5. State Your Primary Business Location

Enter your LLC’s main business address in the primary business location section. Note that P.O. boxes are NOT allowed. Therefore, you must provide a physical street address.

First, choose “Add a New Address.” Then, enter your business location details. This should include:

  • Country, address line 1, city, state, and ZIP code: These fields are mandatory.
  • Address line 2: A suite or unit number. This section is optional.
  • Attn: If you want to include an address contact. This is also optional.

Finally, state your contact phone number and email address. This allows the DOR to contact your business if needed.

Click “Save and Continue” to move to the next section.

Following this, the system will verify your address. Choose the correct address and click “OK.

6. Withholding Tax Qualification

Next, you need to complete the Withholding Tax Qualification section. To do this, answer questions to determine whether your LLC needs a Kentucky Employer’s Withholding Tax Account.

The online portal will prompt you to set up a Withholding Tax Account if you answer “Yes” to any of the questions.

Click “Save and Continue” once you’ve completed the required information.

7. Sales And Use Tax Qualification

The state imposes a statewide 6% sales and use tax on taxable goods, digital property, and certain services. There is NO additional county or local sales taxes.

Note: Click the “?” icon when processing to read detailed information on each question.

You must create a Sales and Use Tax account and provide additional details if you’ve selected “Yes” for any of the questions. This includes your Sales and Use Tax location, collected Sales Tax, beginning date, and estimated gross monthly Sales Tax.

You need to register for a Sales and Use Tax account first if you answer “Yes” to any question in the sections discussing special tax accounts. This includes the Coal Severance/Processing Tax Account, which requires a Coal Seller/Purchaser Certificate ID Number. The system will then assign you a number.

You must answer “No” to each section that does NOT apply to your business. Make sure you don’t leave any questions blank.

Note: Select “No” if you don’t participate in any of the stated activities. Then, the Consumer’s Use Tax account registration will appear.

a. Sales And Use Tax Qualification

Generally speaking, every LLC regularly selling tangible goods, digital products, or certain taxable services in Kentucky must collect and remit Sales Tax.

b. Services Provided

This section asks whether your LLC conducts certain special sales activities that require additional Sales Tax schedules or reporting.

Examples include aviation jet fuel sales, stallion breeding fees, and motor vehicle or recreational vehicle sales to residents of certain listed states.

c. Sales And Use Tax Account Schedules

Next, you’ll be asked if your LLC conducts certain special sales activities requiring specific Sales Tax schedules or additional reporting.

d. Transient Room Tax Account

Underneath, the next section asks if your LLC rents temporary lodging in the state and requires a transient room tax account. This applies to most businesses that rent rooms, campsites, or other accommodations for less than 30 continuous days. Examples include hotels, motels, inns, campgrounds, or RV parks.

e. Motor Vehicle Tire Fee Account

Next, you’ll be asked if your LLC sells new motor vehicle tires in Kentucky and requires a Motor Vehicle Tire Fee Account.

f. Commercial Mobile Radio Service (CMRS) Prepaid Service Charge Account

After answering questions regarding the motor vehicle tire fee, you’ll be asked if your LLC sells prepaid wireless communication services in Kentucky. This applies to LLCs that sell prepaid mobile phone services, prepaid calling cards, or similar wireless services that require collecting the CMRS prepaid service charge.

g. Utility Gross Receipts License Tax Account And/Or Telecommunications Tax Account

This part of your application process will be used to determine if your LLC provides utility or telecommunications services in Kentucky or qualifies for certain utility-related tax programs.

You’ll need to answer questions about your Energy Direct Pay Authorization (UGRLT Exemption), utility services (sewer, water, gas, electricity), telecommunications services (satellite, communication, cable, or streaming), and purchases made from out-of-state providers.

h. Coal Severance/Processing Tax Account And/Or A Coal Seller Purchaser Certificate ID# Qualification

The next section discusses whether your LLC mines, processes, or brokers coal in Kentucky. Questions are related to whether your LLC mines coal with mineral rights, purchases coal for processing and resale, or buys and sells coal as a broker.

8. Consumer’s Use Tax Account Registration

This section determines whether your LLC needs to register for a Consumer’s Use Tax Account. This only appears when all questions in “Sales and Use Tax Qualification” are answered “No.

If your LLC regularly purchases taxable goods or services from out-of-state sellers without being charged Sales Tax, it must report and pay the 6% Kentucky Use Tax. Examples include online and catalog purchases.

9. Corporation Income Tax Account And/Or LLET Account Qualification

The next part of your application process is used to decide if your LLC needs to register for the Kentucky LLET. This applies to businesses protected from liability under Kentucky law. 

You will be asked if your LLC has any legal registration, business activity, property, employees, sales, or income connected to Kentucky.

10. Non-Resident Income Tax Withholding On Distributive Share Income Tax Account Qualification

In this section, the answers you provide are used to determine if your pass-through entity has non-resident owners who receive Kentucky income.

This section only applies to LLCs with non-resident partners, shareholders, or members who receive distributive share income from sources in Kentucky. If this applies, LLCs need to withhold Kentucky Income Tax on the income and report it to the DOR.

11. Tobacco Tax Account/License Qualification

Next, you need to answer questions regarding the sale of cigarettes, tobacco products, and/or vapor products. If your business sells any of these, you must answer “Yes” and set up a Tobacco Tax Account.

12. Add LLC Members

This part of your application requires you to add your LLC members. You need to add at least one LLC member before moving to the next part of your application.

To begin, click “Add.”

Next, choose whether the LLC member is an individual or a business. Then, enter their ID (this will be their Social Security Number (SSN) for an individual and their EIN for a business). 

Finally, provide their name and personal information. This includes their date of birth and full address.

The system should then take you back to the main page. You can repeat the same process if you need to add more. Otherwise, click “Save and Continue.

13. Add Additional Responsible Parties

If your LLC is a single-member LLC, you can add a manager in this section. To do this, click “Add” and complete the same process that you used when adding members.

Note: This section is optional. Therefore, you can just click “Save and Continue” if you want.

14. Previously Uploaded Attachments

You can upload your required attachments in this section if required in a previous section. These are some of the common attachments that you might upload:

  • List of additional locations: You need to provide a separate attachment listing each business location if your LLC operates in multiple locations. This includes the business name, address, phone number, date opened, and chosen business activities.
  • Responsible party information: This contains detailed information on individuals responsible for your tax accounts. Examples include their SSN, driver’s licenses, and official titles.
  • Legal documents: This depends on your chosen business structure. You may need to provide copies of your Articles of Organization/Incorporation.
  • Utility Gross Receipts License Tax Exemption: A copy of your official exemption authorization may be required.
  • Proof of purchase: You must provide details or documents regarding the transaction if you purchased an existing business.

Click “Save and Continue” if you don’t need to upload anything in this section.

15. Summary Information Page

In the summary information page, carefully check your business information. Click “Back” to go back to a previous section if you need to make any edits.

17. The Approval Process

Your expected processing time is around 5-10 business days when submitting your Kentucky Tax Registration Application (Form 10A100) online. The Kentucky DOR will issue you the required tax registration details once your application has been approved.

  • Kentucky tax account numbers: These are unique tax identification numbers that apply to your applicable tax accounts. Examples include the Sales and Use Tax or Employer Withholding Tax.
  • Tax filing instructions and forms: These documents explain how and when to file your required tax returns.
  • Registration confirmation or permits: This is the official confirmation stating that your LLC is registered to collect or pay Kentucky taxes.

How To Register For A Kentucky MyTax Account

1. Go To The Sign Up Page

To begin, access the Kentucky MyTax page. Then, click “Register a new account.

2. Create Your Username

Next, you need to create your username using the following guidelines:

  • It must be between 5 and 20 characters long.
  • It can only contain letters (a-z, A-Z) and numbers (0-9).
  • It can include special characters.

Following this, enter your name, email address, and phone number (optional). Choose “Taxpayer” for your role and click “Sign up.”

3. Email Verification

After providing your email, the system should notify you to check your email. This is the mandatory email verification process.

You should see an email in your inbox. Click “Verify your email.

4. Create A Suitable Password

Next, you need to create a password.

Note: The system will ask if you want to set up security methods. You can ignore this section and go back to the main sign-in page.

Then, enter your password. To do this, navigate back to your inbox and look for an email titled “Welcome to the Kentucky Department of Revenue Taxes Dashboard.” Use the provided password to sign in.

Once you have the default system password, you can set up a new one using the following requirements:

  • At least 14 characters.
  • A lowercase letter.
  • An uppercase letter.
  • A number.
  • A symbol.
  • Do NOT use parts of your username.
  • Do NOT include your first name.
  • Do NOT include your last name.

5. Verify Your Email Again

After creating your password, you need to verify your email again. Click “Send me an email.

Navigate back to your email and check for an email titled “One-time Verification Code – KY DOR Taxes Dashboard.” Then, click “Sign in.

6. Add A Secondary Email (Optional)

In this section, you can provide a secondary email for security purposes. This section is optional. Therefore, you can click “Finish” to complete your account registration.

How To Do Kentucky State Tax Registration Using Paper Form

If you prefer to use a manual filing method, you can complete the Kentucky Tax Registration Application paper form. Once approved, your business will be registered with the Kentucky DOR.

To begin, download the form. Click the provided link or click the “Download” button on the right-hand side of the screen.

The paper form does NOT specify any mandatory printing requirements. Therefore, you can print it on standard U.S. letter (8.5 × 11 inch) paper and ensure the information is clear and legible.

Note: You must answer all questions regarding tax types qualification and tax types registration (from 19 to the end).

Check “No” even if you don’t participate in any stated activities. No questions should be left empty.

1. Reason For Completing The Application

Section A asks you to discuss the reason for completing your application. First, check “Open new business/Began activity in Kentucky” in the Reason For Completing This Application section.

For the Effective Date section, most people enter the current filing date. This is the date that the reason for your application becomes valid.

Underneath, answer Question 2 accordingly:

  • Check “No” if you did NOT receive correspondence from the Division of Registration. You can leave the document number field blank.
  • Check “Yes” and enter the document number if you did.

2. Business / Responsible Party / Contact Information

a. Business Name And EIN

Underneath, questions 4 and 6 ask you to state your legal business name and EIN. The other fields are NOT mandatory, meaning you can leave them blank.

b. General Information

The next section requires you to input your general business information. Fill the applicable fields according to these instructions:

  1. Enter your primary business location address (you can NOT use a P.O. box).
  2. Choose your type of business operations (home-based, web-based, office/store-based, or transient).
  3. Specify your accounting period. This can be a calendar year (year ending December 31st; most common option), a fiscal year (select the month), or a 52/53 week calendar/fiscal year (only choose this if your year follows a 52/53 week schedule).
  4. State your accounting method. Choose “Cash” if you want to report income when received and expenses when paid, or choose “Accrual” to report your income when earned and expenses when incurred.
  5. Choose between “Profit LLC,” “Non-profit LLC,” “Professional LLC,” and “Series LLC” in question 13. “Profit LLC” is the most common LLC type.

c. How Will Your LLC Be Taxed

You have 4 options for your federal tax classification. Choose one of the following:

  • Single-member LLCs: Check the “Single Member Disregarded Entity,” then check “Individual Sole Prop.”
  • Multi-member LLCs: Check “Partnership.”
  • Choose “Corporation” or “S-Corporation” if you’ve filed that tax election with the IRS.

d1. Single-Member LLCs (Taxed As Individual Sole Proprietorships)

Follow these instructions if your LLC is owned by an individual:

  1. Provide your individual owner’s information for question 15.
  2. Add your owner’s SSN for the responsible party identifier.
  3. Enter your owner’s business title (for example, Owner or Sole Proprietor) and the effective date of the title.
  4. Enter your owner’s residence address and phone number.
  5. State your owner’s full legal name. This should be exactly as it appears on official records. Do NOT use abbreviations or nicknames.

d2. Single-Member LLCs (Taxed As Single-Member Disregarded Entities)

Complete the following if your business is a single-member LLC taxed as a disregarded entity:

  • Question 15: Enter the single member’s company information. This should include their Federal Employer Identification Number (FEIN/EIN).
  • Provide the full legal name of your LLC or business entity as registered. Do NOT use abbreviations or nicknames unless they’re part of your official name.
  • Add their business title (e.g., member, manager, managing member) and the effective date of the title.
  • State their business address and contact telephone number.

If your LLC has managers:

  • Enter each manager’s full individual information for question 16.
  • Attach an additional sheet with their details if you have multiple managers.

d3. Multi-Member LLCs (Taxed As A Partnership, C-Corporation, Or S-Corporation)

These instructions apply if your LLC has two or more members:

  • Questions 15 and 16: Enter each partner/member’s information.
  • Add each member’s SSN (individual) or FEIN (another business).
  • Enter their business title (e.g., member, manager, managing member).
  • Provide the effective date of the title.
  • Enter their residence address and number (state the business address if you’re entering for an entity).
  • You must list at least two LLC members. Attach a separate sheet if you have more than two members.

e. Person To Contact Regarding Your Application

Finally, enter the details of the person to contact about your application. This should include their full name, title, daytime telephone number, extension, and e-mail address.

3. Business Activity Information

Section C is about your business activities. For this part, state the basic information regarding your activities in the state. This should include details about any services/products sold.

  • Question 18a: Business activity description: Describe the nature of your Kentucky business activities. This should include a description of the services provided. 
  • Question 18b: Products sold in Kentucky: List any products sold in the state
  • Question 18c: NAICS code: Use the NAICS Lookup website to find the classification that best describes your business. This part is optional.

Note: The following sections are used to determine if your LLC needs to pay different tax types. I’ve provided links to specific tax types in the online guide above. Alternatively, scroll down to the “Instructions” section in the form for further details

4. Withholding Tax Qualification

Answer questions 19 – 22 to determine if your LLC requires a Kentucky Employer’s Withholding Tax Account. You need to complete section D to set up a Withholding Tax Account if you answer “Yes” to any of the questions.

5. Sales And Use Tax Qualification

Complete Section E if you answered “Yes” to any of the questions from 23 to 45E. This must be done to create a Sales and Use Tax Account and provide additional details.

c. Additional Business Activity Questions

Questions 28–37 ask if your business performs certain activities that may require special tax registrations or additional state reporting. Examples include leasing property, remote sales, marketplace sales, or EV charging operations.

d. Sales And Use Tax Account Schedules

The next section of your application asks if your LLC conducts certain special sales activities that require specific Sales Tax schedules or additional reporting.

e. Transient Room Tax Account

Underneath, question 41 asks if your LLC rents temporary lodging in Kentucky. 

Choose “Yes” if your business rents rooms, campsites, or other accommodations for less than 30 continuous days. Examples include hotels, motels, inns, campgrounds, or RV parks.

f. Motor Vehicle Tire Fee Account

Question 42 asks if your LLC sells new motor vehicle tires in the state. Choose “Yes” if your LLC sells new tires for semi-trailers or motor vehicles to customers.

g. CMRS Prepaid Service Charge Account

The next question asks if your LLC sells prepaid wireless communication services in the state. Pick “Yes” if your LLC sells prepaid mobile phone services, prepaid calling cards, or similar wireless services.

h. Utility Gross Receipts License Tax Account And/Or Telecommunications Tax Account

The last part of this section is used to determine if your LLC provides utility or telecommunications services in Kentucky or qualifies for certain utility-related tax programs.

Questions relate to utility services, telecommunication services, Energy Direct Pay Authorization, and any utility purchases made from out-of-state providers.

6. Consumer’s Use Tax Account Qualification

The answer you provide in this section determines if your LLC needs to register for a Consumer’s Use Tax Account. This section only applies if all questions in the “Sales and Use Tax Qualification” section are answered with “No.

If your LLC purchases taxable goods/services from out-of-state sellers without being charged Sales Tax, you must choose “Yes” in this section. Examples include online or catalog purchases. In this case, your LLC must report and pay the 6% Kentucky Use Tax.

7. Corporation Income Tax Account And/Or LLET Account Qualification

Underneath, you need to answer questions related to the Kentucky LLET. This applies to businesses protected from liability under Kentucky law. 

Complete Section I if you answered “Yes” to any of the questions. This allows you to create your LLET Tax Account and provide details such as your date of organization and the date that your business activities began in the state.

8. Non-Resident Income Tax Withholding On Distributive Share Income Tax Account Qualification

This part asks if your pass-through entity has non-resident owners receiving income in Kentucky. Your LLC must withhold and report Kentucky income tax for them if you answer “Yes.”

9. Coal Severance/Processing Tax Account And/Or Coal Seller Purchaser Certificate ID# Qualification

The final section is used to determine if your LLC mines, processes, or brokers coal in Kentucky. Questions relate to whether your LLC mines coal with mineral rights, purchases coal for processing and resale, or buys and sells coal as a broker.

Note: You will mainly provide basic business information in sections D to K. This includes your address, date or organization, and estimated sales. This information is mainly used to create your tax accounts.

I advise carefully following the form instructions and consulting a professional if needed.

10. Add Your Signature

Once you’ve finished the required sections, you must print out your completed form and provide your signature in the “Signature” field. The signature must be from someone authorized to represent your LLC.

Complete the following information:

  • Printed name of your signer.
  • Phone number.
  • Title (member, manager, or owner).
  • Date (MM/DD/YYYY format).

Once signed, you certify that the provided information is accurate and complete to the best of your knowledge.

11. File Your Completed Form

Your application should be ready to file once you’ve completed the required information and signed at the bottom.

Finally, you need to prepare additional attachments (if needed). Some of the common ones include:

  • Legal documents: You may need copies of your Articles of Incorporation or Organization, depending on your business structure. However, the SOS’s organization number is usually enough.
  • Responsible party information: Provide detailed information regarding individuals responsible for the tax accounts (SSN, title, driver’s licenses).
  • List of additional locations: Add a separate attachment if your business operates in multiple locations. This should include each location’s name, phone number, address, date opened, and business activities.
  • Proof of purchase: You may need to provide details or documents related to the transaction if you’ve purchased an existing business.
  • Utility Gross Receipts License Tax Exemption: A copy of your official exemption authorization.

Then, submit your completed dossier to the Kentucky DOR, Division of Registration:

Note: Make sure that your form is fully completed and signed before submission to avoid processing delays.

12. Approval Process

It may take up to 3 weeks plus mail time to be approved if you submit your Kentucky Tax Registration Application (Form 10A100) by mail.

Once approved, the Kentucky DOR will provide you with the necessary tax registration details. These include your:

  • Kentucky tax account numbers: identification numbers for each applicable tax account. Examples include Employer Withholding Tax and the Sales and Use Tax.
  • Tax filing instructions and forms: Documents explaining how and when to file your required tax returns.
  • Registration confirmation or permits: Official confirmation that your LLC is registered to collect or pay Kentucky taxes.

The Importance Of Completing The Kentucky Tax Registration Process

Your Kentucky LLC faces several negative consequences if you fail to complete your required registrations on time. Alongside this, you won’t be able to file your required reports or pay mandatory taxes on time, leading to further operational issues. These are set under KRS 131.180.

1. Failure To Register

Under KRS 131.180(5), your LLC may face a penalty equal to 10% of your required fee ($50 minimum penalty) if it fails to obtain its required identification number, license, permit, or other document of authority.

2. Failure To File Report Or Provide Information

If your LLC fails to file its required reports or provide any requested business details, the DOR may impose a 5% penalty on the assessed tax under KRS 131.180(3). This applies to every 30 days that your report is NOT filed (up to 50% of your assessed tax with a minimum $100 penalty).

3. Late Filing Penalty

If you file a mandatory report or return after the due date, your LLC faces a 2% penalty of the total tax due for every 30 days under KRS 131.180(1). This may reach up to 20% of the tax due, with a minimum $10 penalty.

4. Late Payment Penalty

Under KRS 131.180(4), a 2% penalty applies on the unpaid tax for every 30 days until the balance is paid in full. This happens if you don’t pay your assessed tax within 60 days of the due date.
