After forming your Nevada Limited Liability Company (LLC), the next step is to determine whether your business activities require a Nevada Sales and Use Tax Permit. Nevada imposes sales tax on most retail sales of tangible personal property and certain taxable services, although some items and transactions are exempt under state law.

If your LLC engages in taxable sales, you must obtain a Nevada Sales and Use Tax Permit before conducting those transactions. Operating without the required permit may result in penalties, interest, and compliance issues.

In this article, I walk you through the application process step by step so you can obtain your Nevada Sales and Use Tax Permit on your own.

An Overview Of The Nevada Sales And Use Tax Permit

Note: In most cases, you’re legally obligated to remit Sales Tax on your taxable transactions, regardless of whether you have a Nevada Sales & Use Tax Permit. The permit only authorizes you to collect Sales Tax from Nevada customers.

I’ve explained the main consequences of this in the sections below.

A Nevada Sales and Use Tax Permit is the official authorization that allows your LLC to collect and remit sales tax on taxable goods, as defined under NRS § 372.085.

Nevada imposes a 2% state sales tax on retailers for the privilege of selling tangible personal property at retail, calculated on the gross receipts from those sales under NRS § 372.105. In addition to the state rate, local sales taxes may apply depending on the county where the sale occurs.

Beyond engaging in taxable activity, the requirement to obtain a permit is also determined by whether your LLC has nexus in Nevada. Nexus refers to a sufficient connection between your business and the state that creates a tax collection obligation.

Review the table below for a summary of Nevada nexus standards, which I will explain in more detail later.

You must obtain a Nevada Sales and Use Tax Permit BEFORE conducting any taxable sales activities. Before applying, make sure your LLC has obtained an EIN, as the permit application requires a valid EIN to complete the registration process

Each business location must have its own permit, which must be displayed in a conspicuous place. The registration fee is $15 per location, and there is no renewal fee.

1. Filing Methods For The Nevada Sales And Use Tax Permit

Apply for your Sales & Use Tax Permit with the Nevada Department of Taxation using two main methods:

  1. Online: Via the My Nevada Tax portal.
  2. By mail: Complete Form F006, then send it to the Nevada Department of Taxation.

In most cases, you can obtain a Permit ID # within 24 hours when applying online. Mail applications take several weeks and may be delayed if proper payment isn’t included.

How To Get A Nevada Sales And Use Tax Permit Online

To begin your application, you must access the My Nevada Tax page. In the following sections, I’ve written a step-by-step breakdown of the application process.

Before filing, you need to create a My Nevada Tax account. You’ll find how to do this below.

1. Begin Your Filing

Once you’ve logged in to your My Nevada Tax account, click “I want to…” to go to the registration page.

2. Register A New Business

You should see a list of applications that you can complete on the portal. Click “Register a new business” to enter the filing page.

3. Enter Your Business Information

Next, input your LLC’s business information.

  • Select your LLC’s business type: Select “Limited Liability Company” from the “Business Type” dropdown box.
  • Enter your Federal ID: Choose “Federal Employer ID Number” from the “Federal ID Type” dropdown box, then enter your EIN in the “Federal ID” box.
  • Enter your LLC’s legal name: Provide your LLC’s registered name in the “Legal Name” box. This must match the name stated in your Nevada Articles of Organization.
  • Enter your LLC’s Unemployment Insurance Account Number: Click “Yes” and enter the code if your LLC has an Unemployment Insurance Account Number.
  • Enter your LLC’s Nevada Business ID: Select “Yes” and enter your LLC’s Nevada Business ID in the provided field.
  • Select your registration reason: Click “No” for the final question, as you are registering for a new Sales & Use Tax Permit.

4. Continue To The New Business Registration Page

You’ve already filled the required boxes with your LLC’s information. Therefore, you’ll be taken to the Confirmation page.

Press “Continue” to proceed to the next section.

5. Read The Introduction

Next, you need to read the information on the Notification page. This states that the information provided is primarily used to register for Sales & Use Tax and other Nevada Tax accounts.

You’ll also need to provide your:

  • Account activity start dates.
  • Business names used, contact details, and physical addresses.

Note: Sales Tax permits require you to pay a fee for each new business location. Therefore, you may be asked to provide a security deposit when registering a new business that requires a Sales Tax Permit.

6. Provide Your Business Details

Insert your LLC’s business details in the next section. I’ve outlined what you need to provide in the sections below.

a. Mandatory Business Details

In the dropdown box, select your LLC’s formation state.

Note: You may still need to apply for a Sales & Use Tax Permit even if you don’t have a physical presence in the state. This is due to your economic nexus, which I’ll cover below.

Next, find your “Formation date” and “Business start date in Nevada” fields. Look for the calendar icon and select the exact date in accordance with your LLC’s operational records and plans.

Note: Your LLC Formation Date is the effective date that you filed your Nevada formation documents. This includes your Articles of Organization, state business licenses, and initial list of managers or members.

b. Optional Business Details

Underneath, provide your LLC’s other business details. This may include a fictitious name and the number of your LLC employees in the state.

After this, choose your LLC’s preferred language. The state allows you to use English and Spanish.

This box is used if you do NOT want a refund when your account has a credit balance from a financial adjustment or overpayment.

e. Business Nature Description

For this section, give a detailed description of your Nevada business activities. Make sure you include your products sold, services rendered, and labor performed.

7. Enter Your Contact Information

In the next step, provide your LLC’s business contact information. You can use your appointed Registered Agent or your LLC’s contact information for this section.

State your LLC’s or Registered Agent’s email in this section.

b. Phone Number

Using the “Phone Type” dropdown box, choose either “Business Phone” or “Cell Phone.”

Then, enter your phone number in the “Phone Number” box.

Note: You can either add a secondary phone number or move to the next section.

8. State Your LLC’s Headquarters Address

Next, press the “Verify Address” button to verify your input address.

Next, select your exact headquarters address in the “Address Search” table. Then, press “Save.”

c. Mailing Address

Select “Yes” in the question box “Do you want to provide a separate mailing address?” if your LLC’s business location mailing address is different from your physical address. Once selected, you must input your mailing address.

9. Choose An NAICS Code

You’re required to choose a North American Industry Classification System (NAICS) Code for your business according to its activities.

Note: You can choose more than one NAICS code in this section.

b. Search Activity Code

You should see the “Activity Code Search” tool on your screen.

In the “Keyword” box, enter your business keyword.

You should then get a pop-up with the suitable results on the left. Choose the best one to describe your LLC’s business activities.

10. Answer The Initial Questionnaire

You should be directed to a questionnaire with a series of Yes/No answers regarding your LLC. Ensure you answer each question truthfully.

11. Answer The Sales Questionnaire

You will then be taken to a Sales Questionnaire after completing your initial questionnaire. Again, answer all these questions by selecting “Yes” or “No.”

12. Input Your LLC Officers’ Information

Provide the information of your LLC’s Managers, Members, and Officers (Where applicable).

In the “Federal ID Type” dropdown box, choose “Federal Employer ID Number (FEIN)” if you need to add an entity officer. Then, enter your officer’s FEIN (EIN) in the “Federal ID” box.

You’ll need to insert a Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN) if you want to add an individual officer.

Find the calendar icon in the “Start Date” box. Then, choose the first day that your LLC officer is engaged in your Nevada LLC’s business.

Indicate each person’s ownership percentage if you’re entering your LLC’s manager or member information.

First, check “Yes” in the questionnaire box. Then, insert each LLC manager’s/member’s ownership percentage in the “Percent Of The Business Owned” box.

b. Officer Contact

c. Officer Address

Next, insert your LLC Officer’s address using the asterisked boxes provided. Then, confirm your address by pressing the “Verify Address” button.

Click “OK” to move to the next step.

d. Review Your Officer Information

Lastly, review your input officer information. You can click “Add an officer” to add other officers. Alternatively, click “Next” to move to the next section.

14. Sales And Use Tax

Input your LLC’s total estimated monthly sales. Then, select to either file your Sales & Use Tax quarterly or monthly.

Note: Your LLC must report every month if your sales or purchases exceed $10,000 in a month or $30,000 in a quarter.

15. Add Your Business Locations

List all of your LLC’s business locations. Click “Add a location” to begin your filing.

Choose “Yes” if you want to use your headquarters address for your business locations.

Then, fill out the asterisked boxes, including the “Location Doing Business As (DBA) Name” box.

Note: You can ask the Nevada Department of Taxation for further instructions if your LLC location has no DBA.

While you can skip the boxes about your location’s contact person, I advise completing these boxes so the state can contact your LLC quickly if there are any required administrative updates or notifications.

16. Provide The Contact Information For Your Sales & Use Tax Return

Next, fill in your filing contact information to complete your Sales & Use Tax Return.

Note: The portal will use your provided location information for your Sales & Use Tax return correspondence if you choose “No” in this section.

You must review the information before completing your filing. After this, you’ll see your total Nevada Sales & Use Tax Permit fee at the end of the page.

Finally, make your required payment. Select your desired payment method (bank account or credit card). Then, enter the required information.

How To Create A My Nevada Tax Account?

In the following sections, I’ve walked you through the required steps needed to create your Nevada Tax Account. You must complete 5 main steps:

1. Sign Up Page

You should see the login/sign-up window on the My Nevada Tax homepage. Press “Sign Up” to start your account registration.

2. Enter Your Account Information

You’ll then be taken to the registration page. This requires you to enter your account information.

a. Enter Your User Information

First, fill in the applicable boxes with your name, username, and email.

Then, input your password. This must not be reused from any social media sites. Furthermore, it must contain at least 8 characters which include letters and numbers, uppercase and lowercase letters, and special characters.

After this, provide your phone number. This can be your private number or your LLC’s business number.

Press “Verify email” to move to the next filing section.

After providing your email, you should get a verification email with your 6-digit code verification number.

3. Answer A Security Question

Complete the attached Form F006 and send it to the Nevada Department of Taxation at the following address:

Check the box at the top of the section if you need to update your LLC managers/managing members information. You should then get a “Taxpayer Information Update Form.”

15. Line 15: Enter Your Business Starting Date

In Line 15, provide the date that your LLC began operating in the state. Enter the date that your operations will begin if your business hasn’t started yet.

16. Line 16: Nevada Employee Number

Give the approximate number of current LLC employees (You currently have or expect to have) if you have employees who will be or are working in the state.

Enter your issued account number if you’ve already registered your LLC with the Employment Security Division. This is commonly referred to as your UI Number.

Fill the applicable boxes in Line 21 with your LLC’s total Nevada monthly receipt information. This is the total Nevada gross receipts, including exempt sales, wholesale sales, and any necessary services.

Provide your LLC’s estimated total Nevada monthly taxable receipts. This is the total taxable sales of tangible personal property. Do NOT include exempt sales, wholesale sales, and other non-taxable transactions.

23. Line 23: Reporting Cycle

Next, select your desired filing frequency. You must report monthly if your LLC’s taxable sales or purchases exceed $10,000 per month or $30,000 per quarter.

24. Line 24: Security

In Line 24, state the security the state requires as a guarantee to collect unpaid Sales Tax. This is defined as a “sum of money” or a “financial deposit.”

To calculate this, multiply your estimated total state monthly taxable receipts by 8.375% (The state’s highest tax rate). This determines your estimated average monthly tax liability.

Note: You must provide security equal to three times this monthly liability if you file monthly. Businesses that file quarterly must provide six times the monthly liability.

No security deposit is needed if the amount is $1,000 or less. You have no maximum limit on the amount, and may request a waiver of the security requirement after three years of perfect reporting.

25. Line 25: Sales Tax Fee

Each in-state business location requires a $15 Permit Fee. Multiply your number of business locations by the permit fee to calculate your total fee owed.

For example:

You still need to pay a $15 minimum fee if you operate without a physical Nevada location. This applies to out-of-state businesses that have established nexus with the state (They have sufficient connection to the state to have to pay Sales & Use Tax.

Who Must Obtain The Nevada Sales And Use Tax Permit?

Retailers must pay the Nevada Sales Tax for the privilege of selling tangible personal property in the state. You must obtain a Nevada Sales & Use Tax Permit if you engage in taxable retail activity, regardless of your business structure. This is based on the retailer’s gross receipts, including the total amount received from the state (In any form).

You must learn about nexus to fully understand if your LLC needs to collect and remit Nevada Sales Tax. This refers to the connection level that your LLC has with the state. Sales Tax is established in two main ways in the state:

1. Physical Nexus

Your LLC is presumed to have Sales & Use Tax obligations if it’s part of a controlled group or affiliated entity with a physical presence in the state. This is stated under NRS § 372.7243.1.

Specifically, your LLC is considered to have a physical nexus if a related state company sells similar products under the same or a similar name or operates a warehouse, office, or distribution facility supporting your LLC’s deliveries. This also applies to similar trade names or trademarks.

2. Economic Nexus

According to the Wayfair decision, the Nevada economic nexus rules require remote sellers to register and collect Sales & Use Tax if their business activities exceed the set state economic threshold.

Marketplace sellers, remote sellers, and marketplace facilitators must calculate their total state sales for the previous and current year up to the assessment date. This ensures that they evaluate their Nevada business activity.

  • They must register for a Nevada Sales & Use Tax Permit and begin collecting and remitting tax if they exceed $100,000 in Nevada sales or complete 200 or more transactions in a year. This applies even if you don’t have a physical presence in the state.

In summary, economic activity can create a nexus on its own. Tax obligations apply once these stated thresholds are met.

Cost Of The Nevada Sales And Use Tax Permit

Your Nevada Sales & Use Tax Permit costs $15 to obtain. This must be displayed at each operating business location.

You do NOT need to renew your Nevada Sales Tax Permit, meaning you have NO required renewal fees.

While the Nevada statutes do NOT specifically state this, your Sales & Use Tax Permit may be canceled if you fail to file or remit the required Sales Tax returns. This will be carried out by the Nevada Department of Taxation.

You must register for a new permit if you open additional business locations.

Why Do You Need A Sales And Use Tax License For Your LLC?

I’ve explained why your permit is necessary and how it affects your business’s ability to stay compliant and obtain the necessary local licenses in the following sections.

1. Possible Administrative Penalties

While it’s not clearly shown in the state legislature, your LLC may be considered as “operating without a license” if your license is NOT properly displayed.

In this case, you may face the same penalties described above, such as fines, additional fees, misdemeanor charges, and potential business suspension.

Make sure you do the following to avoid this:

  • Clearly display your license at your physical business location. This must be clearly seen by both customers and inspectors.
  • Provide a copy of the Sales & Use Tax License at each of your operating locations if you operate at multiple sites.

You expose your LLC to several penalties if you operate in the state without obtaining the required Sales & Use Tax Permit.

This is seen as a “violation of Sales & Use tax laws.” This may make your LLC liable for unpaid taxes, penalties, and interest.

Late or missed filings may result in fines ranging from 2% to 10%, depending on how many days your return is overdue. Furthermore, you face 0.75% monthly interest on outstanding amounts.

Failing to maintain the required records or attempting to evade tax is seen as a more serious violation. This may lead to severe penalties, which include fines and imprisonment.

3. You Need One For Local Licensing

Many Nevada counties and cities won’t issue a local business license until you provide proof of registration with the Nevada Department of Taxation. Therefore, you must obtain a Nevada Sales & Use Tax Permit.

This may include a copy of your Sales Tax Permit, a stamped copy of your Nevada Business Registration or Sales Tax Permit, or confirmation from the Nevada online portal.

While local requirements can vary, state registration is typically required before you can complete your Local Licensing requirements.
