Overview Of Kansas Sales Tax Permit

Under K.S.A. 79-3608, your Limited Liability Company (LLC) must register for a Retailers’ Sales Tax Registration Certificate or Sales Tax Permit with the Kansas Department of Revenue (DOR) if your business activities are subject to Sales Tax in Kansas. This must be done before you conduct any taxable activities in the state.

The registration for a Sales Tax Permit is completely FREE.

In terms of the Kansas State Sales Tax rate, the state charges a 6.5% State Sales Tax on retail sales or rentals of physical goods, certain related services, and admissions to entertainment or recreational venues. Furthermore, some cities and counties may charge their own Kansas Sales Tax rates.

Despite having different rates at the local and state levels, you only need to report and remit the total amount collected to the Kansas DOR.

You must obtain a separate Sales Tax Permit for each operating location during the registration process. Once issued, each permit should be displayed correctly to maintain compliance. Alongside this, you need to file and pay taxes on time to avoid business suspension or revocation. This applies despite permits having no renewal requirements.

1. Filing Methods

You must register for a Kansas Sales Tax Permit to legally collect and remit Sales Tax. You can do this using two main methods. The registration will also issue other tax accounts (if applicable to your LLC).

  • Online: Use the Business Tax Registration online page. It takes approximately 1-2 business days for your application to be approved.
  • By mail/fax: Complete the Business Tax Application (CR-16) form. Your application should take 3-4 weeks to complete.
  • In person: Complete the form and file it in person at the KDOR office. Your filing should be approved on the same day.

2. Who Should Register For A Kansas Sales Tax Permit?

Your Kansas Sales Tax requirements depend on whether your business operates in Kansas or sells to customers located in Kansas.

In-state sellers are classed as:

  • Businesses located in Kansas that sell taxable goods and services.
  • Service providers, retailers, and anyone making sales in Kansas.
  • State businesses with a physical presence (stores, offices, and warehouses).

Out-of-state sellers are classed as:

  • Businesses NOT located in the state but selling to state customers.
  • Sellers shipping goods into the state.
  • Remote sellers meeting the economic nexus thresholds ($100,000).

1. Log In

To begin, visit the Kansas DOR Customer Service Center. Provide your email and password information and click “Sign in.”

3. Reason For This Application

4. Select Your Applicable Tax Types

Next, select the tax types that you wish to apply for. My guide focuses on the Retailer’s Sales Tax. However, you can choose other tax types, based on your operating location and chosen activities.

5. State Your Business Information

Add your business information in the applicable fields:

  • Type of Ownership: Choose “Limited Liability Company.”
  • Business Name: State your business name exactly as shown on your approved Articles of Organization.
  • Federal Employer Identification Number (EIN): Provide your EIN.
  • Contact Name, Phone Number, and Email Address: These should be auto-filled if you’ve previously registered an account. You can change these details if needed.

6. Provide Your Business Mailing Address

After providing your mailing address, enter your business mailing address. This should include your street address, city, county, state, and ZIP code. You can use a P.O. box for this section.

You can also provide your business website in the “Web Page Address” field. However, this is optional and can be left blank.

7. Choose Your Accounting Method

Choose “Cash Basis” or “Accrual Basis” for your business accounting method.

  • Cash: Income is reported when received, and expenses are reported when paid.
  • Accrual: Income is reported when earned, and expenses are reported when incurred.

8. State Your Business Classification (NAICS)

Next, input your NAICS code in the “Business Classification” field. You can click “Help with Code” to find the correct code if you’re unsure.

Click “Save & Continue” to proceed.

9. Parent Company

In this section, add your LLC’s parent company if required. To do this, click “Add parent company” and enter its name, EIN, and full address.

10. Subsidiary Companies

If required, you can also add your LLC’s subsidiary companies (child companies). Click “Add subsidiary company,” then enter its name, EIN, and address.

11. Business Tax Account Numbers

This section asks you to enter previously held or currently used numbers. As you’re submitting a new application, you can click “Continue.”

12. Add Your Business Location Address

The location you use in this section applies to your Retailer’s Sales Tax (or any other types of tax if you register them too). 

a. Doing-Business-As Name (DBA)

First, enter your business trade name or DBA. Kansas LLCs can NOT register a trade name or DBA with the SOS. Therefore, just enter your business name as it’s known to the general public.

b. Business Location Address

Enter your business street address. This must be the actual physical location and NOT a P.O. box.

Use a home address if your business is operated out of a home. If the location is on a rural route, include the rural route box number.

You need to check whether the city of your business location requires Local Sales Tax. First, state whether your physical location is within a city limit. If it is, name the city. If you choose “Yes,” the system will normally auto-generate your business address.

c. NAICS

Next, provide your NAICS code in the applicable field. Click “Help with Code” if you’re unsure how to search for the correct one.

Click “Save & Continue” to proceed once you’ve completed the required information.

13. Sales/Compensating Use Tax

Provide the date that your LLC began making sales in the state. As I’ve said above, you must obtain your Sales Tax Permit before making taxable sales.

Answer the required Sales and Use Tax questions based on your chosen business activities. Examples include shipping, locations, seasonal operations, and internet sales.

Then, estimate your annual Kansas sales or use tax liability. Select the necessary filing frequency and click “Save & Continue” to proceed once you’ve completed the required fields.

14. Review Your Business Locations

Carefully review your business location details. This includes your name, address, and tax type. Click “Edit” if you need to make changes or click “Delete” to remove the location.

You can include additional locations by clicking the “Add location” button. Click “Continue” to proceed once everything looks correct.

15. Review Your Business Tax Application

In this section, you’ll find a list of tax types. I’m only registering for the Retailer’s Sales Tax in this guide. Therefore, you will only see one account in the picture below. If you register for other tax types, they’ll appear underneath.

Click “Continue” to proceed.

16. List Of Owners

After reviewing your application, you need to add your list of LLC owners. You must add at least one owner, and the total ownership percentage must equal 100%.

a. If Owner Is An Individual

Select “Individual” if your LLC owner is an individual. Following this, the required information fields should appear.

Provide your LLC owner’s name and select their relationship type from the dropdown box. Then, answer the following;

  • Power of Attorney: Confirm who has the power to handle business, tax, or legal matters on behalf of the LLC owner.
  • Proof of Executor: This person is legally authorized to manage your LLC’s estate.

Enter the person’s home address in the applicable fields.

a3. Percent Of Ownership

First, enter the date that the person will operate as part of your LLC.

Then, enter their ownership percentage. This must be in the format from 000.0000 to 100.0000. For example, if your ownership is 50%, enter 050.0000.

After this, answer the question regarding the person’s power over business assets and funds. 

Click “Save & Continue” once everything is complete.

b. If Owner Is A Business

Select “Business” if your LLC owner is a business entity. The required information fields will then appear.

Enter your LLC owner’s name (as legally shown on your formation documents). Then, choose the relationship type for your business using the dropdown box.

Following this, answer these questions:

  • Power of Attorney: Who has the power to handle business, tax, or legal matters on behalf of the LLC owner?
  • Proof of Executor: Who is legally authorized to manage your LLC’s estate?

c. Review The Owner(s) List

The system should generate a list of LLC owner(s) once everything has been added. You can repeat the same process if you need to add more, as long as the total ownership percentage is 100%.

You can edit each owner’s information by clicking “Edit”.

17. Review Your Completed Application

Carefully review your application. Click “Edit” if you need to make any changes. If not, click “Submit” to proceed to the next section.

18. Your Approval Timeframe

It typically takes 2-3 days for your application to be approved once it’s submitted. Following this, you should receive your Sales Tax Account Number along with further instructions.

The state will notify you of the reason behind your rejection if your application is denied. If this happens, correct the errors and resubmit your application.

Creating Your Kansas DOR Account

1. Start Your Registration Process

Access the Kansas DOR Customer Service Center. Then, click “Register Now.”

2. Add Your Name And Contact Information

Next, enter the following name and contact information:

  • Name: Your LLC name.
  • Contact name: Your full name.
  • Telephone number: Your personal phone number or your business phone number. It must be contactable. 

Other fields are NOT required. Therefore, you can leave them blank or enter the information as needed.

3. Enter Your Email Address And Login

Underneath, provide your email address. You can use your own email address or a business email address. Make sure you have access to it so you can receive your verification code.

Then, create your password. This must fulfil the following requirements:

  • It should contain uppercase letters, lowercase letters, numbers, and special characters.
  • It can NOT contain your name, email, dictionary words, or simple patterns.
  • It must be at least 8 characters long. There is no maximum length limit.

Note: When entering your password, it will change to red/yellow/green, depending on how secure it is. Make sure it turns green to make your password safe.

4. Select A Security Question

After creating your password, select a security question from the dropdown list and choose an answer.

The setting is automatically “accounts”, so you don’t need to do anything here. Verify the Captcha and click “Continue.”

5. Review Your Information

Carefully review your information again. Click “Edit” if you need to fix anything. If everything looks good, click “Register with this information.”

Then, click “Continue” again to enter the verification code. 

6. Verification Code

You should see an email from the Kansas Customer Service Center. Open it and copy the verification code into the required field. Finally, click “Continue.”

Your online account is now successfully created. You can start registering for your Kansas Sales Tax Permit.

How To Get A Kansas Sales Tax Permit By Paper Form

Note: If you’re completing a paper application, you’ll need to link your Sales Tax account to the online system once your filing has been approved. This is required as the Kansas DOR requires all tax returns to be filed electronically.

You can complete the Business Tax Application (CR-16) form if you would prefer to use a manual filing method.

Download the form to begin. You can do this by clicking on the provided link or clicking the “Download” button on the right-hand side of the screen.

File your completed paper form by mail/fax, or in person at the DOR office:

  • Mail/Fax: Normally approved within 3-4 weeks.
  • In-person: Approved on the same day.

There are NO mandatory printing requirements when filing your paper form. Therefore, print it using standard U.S. letter (8.5 Ă— 11 inch) paper and ensure the information is clear and legible.

State your business information using the following fields:

This section asks if you’ve registered for Streamlined Sales Tax. You can indicate “Yes” or “No.“

12. State Your Location Information

The stated location in this section will be used for your Retailer’s Sales Tax location information. Complete Part 4 and Form CR-17 (Registration Schedule for Additional Location) for each additional location if you have more than one.

a. DBA Name

First, provide the trade name of business or DBA. As stated above, Kansas LLCs can NOT register a Trade Name or DBA with the Kansas Secretary of State (SOS). Therefore, just enter your normal business name.

b. Business Location Address

Provide the street address of your business’s actual physical location (this can NOT be a P.O. box). Use a home address if your business is operated out of a home location. If it’s on a rural route, include the rural route box number.

Make sure that you check whether the city where your business is located has a Local Sales Tax. You need to indicate whether your physical business location is within a city limit and name the city if so.

13. Sales Tax And Compensating Use Tax

State the date that your LLC began making sales in the state. Then, answer the required Sales and Use Tax questions based on your business activities. Examples include seasonal operations, shipping, and internet sales.

14. Complete The Ownership Disclosure And Signature Statement

You can enter up to 3 LLC owners or officers in this section.

Provide the full details of each LLC owner or officer:

  • Full name.
  • Social Security Number (SSN).
  • Home address.
  • Contact information.
  • Title.
  • Ownership percentage.

Also, indicate if the individual has the authority over your business funds and provide the date that they became an owner or officer.

Once complete, print the form, sign it, and state the current date. Repeat this for each additional owner if needed.

15. File Your Completed Form

My form guide only registers for Sales Tax. Therefore, I don’t need to attach any payment forms. You will need to make a check or money order made payable to the Kansas DOR if you register for other tax types requiring payment.

Place your completed form in an envelope and send it to the following address:

  • Mail: Kansas DOR, PO Box 3506, Topeka, KS 66625-3506.
  • Fax: 785-291-3614.

If you file in person, go to the DOR office at:

You will need to schedule an appointment at https://telegov.egov.com/kdor-tac to file in person.

16. The Approval Process

Your application may be approved on the same day if you file in person.

If filing by mail or fax, it takes around 3-4 weeks for your application to be approved. Once approved, you need to connect your Sales Tax account to your online platform. This is because the DOR requires you to file your returns electronically.

Follow these steps to connect your account:

  • Navigate to the Kansas DOR Customer Service Center and create your account.
  • Contact electronic services to get your access code.
  • Connect your tax account to your login.
  • Begin your filing.

The Kansas Sales Tax Permit Additional Requirements

1. Displaying Rules For Each Location’s Permit

As I’ve said above, you must obtain a separate Sales Tax Permit for each operating location. Furthermore, each permit should be displayed at that location. This is stated under K.S.A. 79-3608(b).

The Kansas DOR may assume that you haven’t obtained your Sales Tax Permit if you fail to properly display your registration. This can lead to serious consequences, including fraud penalties, monetary penalties, and potential criminal charges. I’ve explained these penalties in more detail below.

2. Renewal Requirements

You do NOT need to renew your Retailers’ Sales Tax Permits in Kansas. They remain valid until your LLC decides to cancel them. However, they’re non-transferable, meaning that you need to obtain a new certificate if you change name, ownership, or operating location.

Alongside this, you must pay your required taxes by the stated due dates to avoid having your permit revoked. This is stated under K.S.A. 79-3608(d). The Kansas DOR may suspend or revoke your Kansas Sales Tax Certificate if you fail to pay your Sales Tax or file your required returns for 60 days or more. This happens after providing 30 days’ notice for the disciplinary hearing.

The Importance Of Obtaining Your Kansas Sales Tax Permit

As stated, you must collect Kansas state Sales Tax and obtain your Sales Tax Registration Certificate (Retailer’s Sales Tax Permit). If your LLC sells or leases physical goods, provides certain taxable services, or charges admission to recreational or entertainment activities.

Your LLC faces several negative consequences if you fail to comply with the law. I’ve discussed these in detail below.

1. Non-Compliance Monetary Penalty

The state may ask you to pay all unpaid Sales Taxes if you operate without registering. These should have already been collected along with the additional penalties and accrued interest.

The following penalties may apply if you fail to pay or report your required Sales Tax under K.S.A. 79-3615(d):

  • Late payment penalty: This is set at 1% of the unpaid tax per month (or part of a month). It can reach a maximum of 24% of the total unpaid tax.
  • Non-compliance penalty: An additional 25% penalty on the unpaid tax balance may be imposed if the state determines that you did NOT make a reasonable effort to follow the law.

2. Fraud Penalty

Under K.S.A. 79-3615(e), the penalty may increase to 50% of the unpaid tax amount if your failure to file or pay taxes is determined to be fraudulent.

3. Criminal Offense

LLCs that continue to sell taxable goods and/or services once their registration has been suspended or revoked are considered to be operating illegally within the state under Kansas Law.

According to K.S.A. 79-3615(h), willfully failing to file required returns, pay taxes, or maintain false business records may result in fines of $500 and $10,000, jail time from 1 to 6 months, or both.
