1. Reserving Your LLC Name ($0–$5)

Before forming your New York LLC, your first step is to make sure your desired business name is available. It needs to be unique and distinguishable compared to existing businesses on the New York database. Furthermore, it must meet the state business naming requirements, which is also something many people check early when estimating their LLC New York cost.

You can use two main methods to check business name availability in New York:

  1. Use the Corporation and Business Entity Database. This is free and lets you view active business names already on record.
  2. Submit a written name availability request to the Department of State ($5 per name).

Because of this, you’re not required to appoint your own Registered agent. However, I strongly advise that you hire your own professional Registered Agent service to ensure all state regulatory requirements and legal mail are handled according to your business needs.

Your Articles of Organization officially form your LLC with the New York Department of State. It contains key business details, including your LLC name, address, and Registered Agent details. Once approved, your LLC is legally recognized as an independent business entity.

Both newspapers will send you Affidavits of Publication once the state requirements are met. These must be filed with the New York Department of State along with your Certificate of Publication and a $50 filing fee.

  • Single-member LLCs are treated as Disregarded Entities by default.
