Completing this required step ensures that the state maintains up-to-date business information. Alongside this, you need to pay for several LLC formation and operational expenses, such as paying for your necessary taxes and business licenses.

How Much Does A Kansas LLC Cost?

1. Choose Your Desired LLC Name ($0)
When forming an LLC in Kansas, your first step is to choose a unique business name. Your name must be unique and distinguishable from existing business names registered in the state under K.S.A. 17-7918. You must complete this step before filing your Articles of Organization formation documents.

To confirm your name availability, compare your desired LLC name against existing business names using the Name Availability Search tool. The tool is completely free to use.
While you do NOT need to reserve your desired LLC name before filing your LLC formation documents, I highly advise doing so if you want to delay your LLC formation date.

2. Appoint A Kansas Registered Agent ($0–$199 Annually)
Note: The official term for a Registered Agent in Kansas is “Resident Agent.”
Both terms mean the same thing, so I will use them interchangeably throughout this article.
Under K.S.A. 17-7925, every LLC (domestic and foreign) conducting business in the state must appoint and continuously maintain an official Registered Agent. The main role of your agent is to receive and process official state regulatory correspondence, legal filings, and service of process on behalf of your LLC.

Your Kansas Registered Agent must meet two main requirements:
- They must maintain a physical street address in Kansas.
- They need to be available during normal operating hours.
You can choose the following as your Kansas Registered Agent under official state law, as long as they meet the requirements stated above:
- An individual: This can be yourself, a family member, or a trusted friend (they must live in Kansas).
- A domestic/foreign business entity: The business must be officially authorized to conduct business in the state. You can use your newly-formed business to be your own agent in Kansas.
If you appoint yourself or another individual as your agent, you do NOT need to pay any fee. However, this creates several serious operational risks:
- Identity theft: Your agent’s name and address appear on the Kansas public record. This can expose your personal information when serving as your own agent.
- Compliance: Your agent must be available during normal business hours to receive and process legal notices and government documents. Your business could face legal or compliance issues if an individual misses these deliveries.
Note: I highly recommend hiring a professional Registered Agent instead of using an individual. This ensures that your personal details are protected and reduces the risk of missing important compliance notices and deadlines.
Generally speaking, your annual Registered Agent costs are around $150 to $199.

3. File Your Articles Of Organization Documents ($85 – $115)

You must file your Kansas LLC Articles of Organization with the Kansas SOS to officially become recognized as a separate legal entity under K.S.A. 17-7673. This one-time filing is your main LLC formation requirement.

Your one-time filing fee is based on your chosen filing method and business type.

4. Complete Your Kansas LLC Operating Agreement ($0)
A Kansas internal Operating Agreement is an internal agreement among LLC members. This is set under K.S.A. 17-7663. It sets internal rules regarding your operational and management procedures. In other words, it acts as a crucial internal rulebook governing most of your LLC’s decision-making processes.
You do NOT need to maintain an Operating Agreement in Kansas. However, I highly recommend getting one. Once LLC members sign, they’re legally bound by the terms.

Your Kansas Operating Agreement can be written, oral, or implied. Furthermore, it can consist of multiple documents, depending on your business structure and operational needs. Despite this, I highly recommend using a written Operating Agreement.
You should keep an up-to-date, signed copy with your official business records. Also, make sure each LLC member also maintains an updated copy for their reference.
Your Kansas Operating Agreement must define your LLC management structure. This can either be:
- Member-managed: All LLC members are responsible for daily operations and can bind the LLC in contracts.
- Manager-managed: Members appoint one or more managers to run the LLC. Other members act as passive investors.

5. Obtain Your EIN ($0)
Before operating your Kansas LLC, you need to obtain an EIN from the Internal Revenue Service (IRS). This is free to obtain ($0) and is required to complete several vital operational activities.
These include:
- Opening a dedicated business bank account.
- Hiring LLC employees.
- Filing required federal and state business taxes.
Note: You must wait until your LLC has been officially approved by the state before applying for your EIN. First, file your Articles of Organization formation documents and get approval from the Kansas SOS. The IRS requires that you exist as a separate legal entity before issuing your EIN.

8. Acquire Your Mandatory Business Licenses And Permits (Varies)
Note: There is NO statewide general business license requirement when operating in Kansas. Because of this, your main requirements depend on your business location and chosen operating industry.
Because of the above point, the cost of your municipal and professional licenses varies widely. Generally speaking, license fees range from $50 to over $1,000. Most licenses require periodic renewal, with fees going from $25 to several hundred dollars.
In some cases, you may NOT need any permits or licenses. If this is true, your total licensing cost would be $0.
I highly recommend contacting the appropriate licensing agency to confirm your specific licensing requirements and fees. For example, some healthcare businesses need to acquire a license from the Kansas Department for Aging and Disability Services. Furthermore, property use may require local zoning approval.

7. Get Your Sales Tax Permit ($0)
Every LLC selling or renting goods, providing certain taxable services, or charging admission to recreational or entertainment venues must collect Kansas state Sales Tax at a rate of 6.5%. If this applies, your business is also required to obtain a Sales Tax Registration Certificate (Retailer’s Sales Tax License).
To do this, register your business with the Kansas Department of Revenue (DOR) under K.S.A. 79-3608. It’s completely free to complete your registration process.

Register your business with the DOR using 2 main methods:
- Online: Use the Business Tax Registration online portal.
- By mail: Use the Business Tax Application (CR-16) form. You can also file your completed form by fax or in person at the official Kansas DOR office.

8. File Your Kansas LLC Biennial Report ($90 – $110 Biennially)
Every Kansas LLC conducting business in the state must file a Biennial Report with the SOS every two years under K.S.A. 17-7503. This mandatory filing keeps the state up-to-date with your current business information and ensures that your LLC stays active and in good standing with the state.

Your filing fee depends on your chosen filing method:
- Online: $90.
- By mail: $110.
When completing this report, you need to update your LLC’s principal address and member information. However, you can NOT change your LLC’s Registered Agent information. To do this, you need to file a “Resident Agent/Registered Office Change” form and pay the $30 filing fee. You can do this online using the same portal as your Biennial Report. Alternatively, you can complete your filing by mail.
Important: Your LLC must file its Information Report by April 15 every two years.

9. Complete Your Kansas LLC Tax Responsibilities (Varies)
After registering with the Kansas DOR, your LLC must meet its ongoing tax obligations. These depend on your operating location and industry.
Note: I recommend hiring a professional accountant when conducting business in Kansas. They’ll handle your tax requirements and ensure your required filings are completed correctly.
a. Federal Taxes
You may need to pay several taxes at the federal level:
- Federal income tax: Depending on your tax treatment.
- Payroll taxes: This applies to LLC members running your LLC.
- Self-employment taxes: This must be paid if you have employees.
b. State-Level Taxes
Your business earnings and activities primarily determine your state-level tax requirements:
- Income tax: Most Kansas LLCs are taxed as pass-through entities. Therefore, profits are reported on the owners’ personal tax returns instead of being taxed at the business level.
- Sales tax: Businesses selling goods or taxable services need to collect and remit Sales Tax to the Kansas DOR.
- Employer taxes: LLCs with employees need to withhold state income tax and pay unemployment insurance (UI) taxes.
c. Local-Level Taxes
In addition to your federal and state-level taxes, you may need to pay local taxes. These are imposed by the cities and counties that you operate in:
- Local sales tax: Certain cities, counties, and special districts may add local rates to your Sales Tax. This brings the combined rate to approximately 6.5%–11.5%, depending on your operating location.
- Property tax: LLCs owning real estate or business equipment may have to pay annual property taxes to the county.
- Business licenses/occupation taxes: Some cities require a local business license or occupation tax to operate in city limits.
- Local income tax: Kansas does NOT allow cities or counties to charge local income tax on business earnings.
