Important: Don’t get confused between your EIN and North Carolina Tax ID Number. They’re NOT the same thing. An EIN is used for federal tax reporting, while a Tax ID Number is issued by the North Carolina Department of Revenue and used for state-level reporting and compliance.
2. Who Needs To Get An EIN?
Note: You must obtain an EIN in North Carolina if you don’t have an SSN, Individual Taxpayer Identification Number (ITIN), or if you’re a foreign entity forming a North Carolina LLC. This is regardless of whether you have one LLC member or multiple members.

Under C.F.R. § 301.6109-1(a)(1)(ii-C), your LLC must obtain an EIN, regardless of whether it is taxed as a Partnership by default or elects Corporate taxation.

It acts as your primary identifier as a Multi-Member LLC. Without one, the IRS can NOT assess your tax obligation, process your filings, or treat you as a separate taxpayer.
b. Single-Member LLCs
You must obtain an EIN as a single-member LLC if you elect S-Corporation or C-Corporation taxation status. However, if you’re a single-member LLC that decided to keep your default federal tax classification and have no employees, you don’t strictly require one.
This is an exception only used in very limited cases. You require an EIN as soon as your LLC has employees or has to file certain Excise Taxes. Therefore, I definitely recommend obtaining one for your ongoing business operations.

Using your SSN instead of your EIN reduces your LLC’s limited liability separation and compliance, which increases the risk of your personal and business finances becoming mixed.
3. When To File For Your North Carolina EIN?
Note: You must get your North Carolina LLC officially approved by the state first before applying for your EIN.

You must do this for the following reasons:

2. The Mail Application Method (For Non-U.S. Citizens)
If you’re a non-U.S. resident, you’ll need to apply for your EIN by mail or fax. This is because the online IRS filing system requires a SSN or an ITIN to complete your application.
Complete Form SS-4 and send it to the IRS using the address or fax number listed on the form.
Your application will be processed anywhere from several days to a few weeks, depending on the current review times and chosen delivery method.

You must understand your LLC’s ownership and business structure before applying for your EIN.
- Don’t submit your EIN until you know the total number of your LLC members.
- You must apply for a new EIN in certain situations. Examples include ownership changes, structural changes, and converting from a Single-Member LLC to a Multi-Member LLC.
- You only need one EIN for your LLC. You must contact the IRS to correct the issue if you have more than one.
- If you’re taking over an existing LLC, you can NOT use the previous owner’s EIN. You must apply for a new EIN specifically for your business.

Tip: I highly recommend applying online as it’s the fastest and most efficient way to obtain your EIN. You can use the mail and fax processing methods, but they take much longer to process. These are mainly used by non-U.S. residents or in certain situations where online filing can’t be completed.
2. Getting An EIN Confirmation Letter
You should receive an EIN Confirmation Letter (CP 575) once the IRS issues your EIN. This is the official proof that your business now has a valid EIN.
Your chosen filing method determines how you receive your confirmation letter:
- Online: You can download your letter immediately once your application is approved.
- Mail/Fax: Your letter will be sent by mail.

3. Finding Your EIN Online
You will NOT be able to get another EIN Confirmation Letter (CP 575) from the IRS if you lose or misplace it.
In this case, you must request an EIN Verification Letter (Form 147C). This has the same legal weight as your initial confirmation letter.
- Local and state agencies will accept both documents when performing essential business tasks.
- This includes opening a dedicated business bank account, applying for applicable business licenses, and filing for required state and federal taxes.
Tip: Make sure you keep your EIN Confirmation Letter with your official business records once you receive it. I highly advise storing it in a safe place along with your other important documents. Losing it causes verification issues, delays, and compliance issues when managing your LLC.

Obtaining your EIN is an essential requirement for operating your North Carolina LLC. Without one, you won’t be recognized as a legally separate business and won’t be able to complete key business activities or meet your compliance requirements set by the state and the IRS.
Disclaimer:
While it’s not explicitly stated in the North Carolina statutes, an EIN is one of the most important identification numbers that you can obtain. While there’s no specific statutory penalty for failing to obtain one, you can NOT operate without one in most cases.
Without an EIN, you face filing delays, incomplete registrations, and potential administrative penalties and complications, all of which heavily disrupt your main business activities.

You need an EIN in North Carolina to complete several official state filings and registrations. An important example is the Sales and Use Tax Certificate of Registration. You can NOT obtain this without having an EIN issued by the IRS.
If your LLC requires a Sales & Use Tax Certificate of Registration, you must get an EIN first to apply for it. This is regardless of whether you submit your filing online or by paper.

2. Federal Requirements
Without an EIN, you can NOT complete several federal tax filing and payment obligations, resulting in serious IRS penalties. These include the following:
- Late filing of tax returns without an extension: 5% penalty on the unpaid tax per month (Capped at 25%). This is stated in IRS, Topic 653.
- Backup withholding on unreported payments: 24% withholding penalty according to 26 U.S.C. §3406(a)–(b).
- Failure to file employment or information returns: A $330 penalty (Up to) per return for the 2025 tax year, as stated in IRS, Information Return Penalties.
- Personal liability for unpaid payroll taxes: Under the Trust Fund Recovery Penalty, responsible individuals may be held personally liable. This is outlined in 26 U.S.C. §6672.
