The Massachusetts EIN is a unique nine-digit federal ID number issued by the IRS and used for federal tax reporting purposes in the state of Massachusetts.

1. When To Apply For Your Massachusetts EIN?

How To Apply For An EIN In Massachusetts

If you’re wondering how to get an EIN for your Massachusetts LLC, the filing process follows the same IRS rules regardless of your business location. Your application methods are the same across all U.S. states. Under IRS guidelines, you have three main submission methods:

  • Online application: The process usually takes 15 minutes.

Your most suitable method depends on your U.S. residency status. More specifically, it depends on whether you have an SSN or an ITIN.

I’ve divided the next section into two groups according to your U.S. residency.

1. Getting Your EIN As A U.S. Citizen

You can use any of the available IRS application methods if you’re a U.S. citizen with a valid SSN or ITIN. However, the online application method is the fastest and easiest way to obtain your EIN.

With other options taking a lot longer, you should only really use them if you experience an error when using the online system or a technical issue with the official portal. I’ve provided detailed guidance on how to do this below.

2. Getting Your EIN As A Non-U.S. Citizen

If you’re a non-U.S. citizen, you can still obtain an EIN for your Massachusetts LLC. However, without a valid SSN or ITIN, you can NOT use the online filing system.

Instead, you need to complete Form SS-4 offline, then submit it to the IRS by fax or mail.

The EIN Confirmation Letter Procedure

Once approved, the IRS will provide your LLC with an EIN Confirmation Letter (CP 575).

Your EIN is typically issued immediately if you apply online. Once you’ve submitted and had your application approved, you’ll be able to download and save Form CP-575 straight away.

If you apply by completing Form SS-4 and sending it by mail, Form CP-575 will be issued to the mailing address given on your application once it’s been processed.

Make sure you keep Form CP-575 securely stored with your business records. This is because state agencies, banks, and tax authorities often require it for filings, account setup procedures, and ongoing compliance requirements.

1. How Do I Find My EIN Number Online?

You will NOT be given a replacement EIN Confirmation Letter from the IRS if you lose Form CP-575 or don’t download it once it’s issued.

Because of this, you must contact the IRS to request an EIN Verification Letter (Form 147C). This confirms that your LLC has a valid EIN and holds the same legal standing as Form CP-575. It will be accepted by all banks, financial institutions, and government agencies.

Call the IRS at 800-829-4933 to request Form 147C. They’re open Monday to Friday, 7:00 a.m. to 7:00 p.m. ET. The IRS may provide your EIN over the phone once you’ve confirmed your identity and LLC authority.

Who Needs To Obtain A Massachusetts EIN

Important: Foreign-owned LLCs must get an EIN regardless of their tax classification. Without a valid SSN or ITIN, you must use your EIN as your primary tax identification number.

Your Massachusetts EIN requirements depend on your LLC’s federal tax classification.

The IRS classifies LLCs into two main categories by default. These are based on the number of LLC members:

  • Multi-member LLCs: Taxed as a partnership.
  • Single-member LLCs: Taxed as a disregarded entity.

You can also elect to be taxed as a corporation (S corporation or C corporation) if you file the correct IRS forms.

1. Single-Member LLC EIN Requirements

You don’t automatically require an EIN if your LLC chooses to keep its default tax classification as a disregarded entity. With no clear separation between yourself and your LLC, you may be able to use your own SSN.

However, this creates several operational risks once your LLC is officially formed and running. I highly recommend getting an EIN to ensure smoother long-term operations. Once your LLC hires employees or is subject to certain excise taxes, obtaining an EIN is a mandatory requirement.

2. Multi-Member LLC EIN Requirements

Note: All multi-member LLCs must obtain an EIN when operating in Massachusetts.

With more than one owner, you’re NOT able to use an individual’s SSN. Multi-member LLCs must obtain an EIN and use it as their tax identifier. This allows the IRS to track your required tax obligations and process filings.

This approach is stated under 26 C.F.R. § 301.6109-1(a)(1)(ii-C).

3. Do LLCs Taxed As A Corporation Need An EIN?

As I’ve stated above, your LLC can elect to be taxed as a corporation (S corporation or C corporation) by filing the correct IRS forms. This is instead of keeping your default tax classification. If you choose this, the IRS will tax your income differently.

Under 26 C.F.R. § 301.6109-1(a)(1)(ii)(C), your LLC must use an EIN as its taxpayer identification number once it chooses corporate tax treatment. Practically speaking, you must obtain an EIN before submitting your corporate tax election forms.

The Importance Of Obtaining An EIN For Your Massachusetts LLC

Your LLC will NOT be fined or face penalties for failing to obtain an EIN. However, you won’t be able to complete your required state filings or federal filings without one. This eventually leads to unwanted consequences.

You must obtain your Massachusetts EIN for three main reasons. I’ve discussed each of these in more detail below.

1. State Requirements

Most Massachusetts LLCs conducting business in the state must register with the Massachusetts Department of Revenue (DOR) for at least one tax account using the MassTaxConnect system. Examples include the Sales and Use Tax and the Withholding Tax.

However, you need to provide an EIN to complete your registration process.

Note: Single-member LLCs are taxed as sole proprietorships at the federal level. However, they’re still classified as separate legal entities formed in Massachusetts and treated differently in the state registration systems.

If you don’t register, you’re NOT exempt from filing your required Massachusetts tax returns, even if NO tax is due. Practically speaking, it increases your risk of:

  • Back taxes for amounts that must be paid.
  • Penalties.
  • Late-payment interest.
  • Enforcement actions and potential criminal exposure (in serious cases).

Example: Most Massachusetts LLCs need to register for a Sales and Use Tax Registration Certificate. Attempting to operate without one increases the risk of:

  • Penalties and interest: Applies to non-filing and non-payment.
  • Criminal exposure: The DOR might consider your failure to register as willful noncompliance. In this case, they may charge a felony punishable by up to $10,000, 5 years in prison, or both under M.G.L. c. 62C § 73.

Note: Alongside this, you may also be faced with personal liability for your LLC’s tax compliance. This applies to your unpaid tax obligations according to M.G.L. c. 62C § 31A.

Your LLC faces serious federal compliance issues if you try to operate without a valid EIN.

a. Failure To Furnish A Required Taxpayer Identification Number

Your LLC may be seen as noncompliant if you’re required to file your federal tax returns but can’t provide a valid EIN.

Example: Your LLC needs to file Form 1099 to report payments made to independent contractors. If you don’t have an EIN, you trigger two penalties under the Internal Revenue Code.

  • Penalties for incorrect or incomplete information returns (IRC § 6721).
  • Penalties for failing to furnish accurate payee statements (IRC § 6722).

The above penalties apply per return, NOT per filing period. As of 2026, the IRS adjusted penalty amounts are as follows:

  • Up to $340 per return (standard penalty).
  • Up to $680 per return/10% of the required amount, if your violation is seen as intentional.

b. Failure To File Returns And Pay Federal Taxes

Your Massachusetts LLC may not be able to complete key federal tax functions without a valid EIN. This includes:

  • Filing federal income tax returns.
  • Issuing or receiving reportable payments.

Under IRC § 6651, you may face penalties if you fail to file your required returns or pay your federal taxes.

Note: Your failure-to-file penalties will be applied by the IRS based on your LLC’s tax classification. Therefore, your penalty rate generally increases the longer your return remains unfiled.

c. Penalties For Payroll And Withholding Noncompliance

You need an EIN to run payroll if your Massachusetts LLC hires employees. As your payroll withholdings are treated as trust-fund taxes, the IRS expects your LLC to withhold and remit them correctly, meaning you must get an EIN.

Under IRC § 6672, non-compliance triggers penalties for responsible individuals. This includes significant penalties and potential criminal exposure in serious cases.

3. Operational Limitations

Practically speaking, you need an EIN so that your LLC can function correctly within the U.S. financial and tax system. Lenders, banks, and state tax agencies will use it as the primary ID number for credit, business accounts, and reporting.

Without one, your LLC may need to rely on personal substitutes. Examples include running transactions through your personal bank account or using your own credit profile for financing. When this happens, you blur the separation between yourself and your LLC and increase your compliance and audit exposure. This puts your personal assets at risk and weakens the liability protections commonly provided by your LLC business structure.

Follow the steps below to speak to a live person:

  1. Press “1” for English.
  2. Press “1” again for EINs.
  3. Press “3” if you have an EIN, but can’t remember it (this is the only live-person option).

Tip: Call as early as possible when the lines open to avoid long holding times. I recommend calling at 7 A.M.
