An Overview Of The Maine EIN

Your Maine EIN is a unique 9-digit federal business identifier issued by the IRS. It functions as your LLC’s federal tax ID for compliance and tax purposes when operating. Furthermore, you will use it when cooperating with the IRS and official agencies such as banks and vendors. Getting an EIN from the IRS is totally free.

Note that your Maine LLC must obtain an EIN if it falls under one of the following categories:

  • Multi-member LLCs.
  • Foreign-owned LLCs.
  • LLCs that elect to be taxed as corporations.
  • LLCs with employees.

You have two main application methods, each with different processing times. Your best option depends on your U.S. residency status and whether you have a Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN). I’ve discussed the application process for both methods in the following sections.

1. EIN Synonyms

Your EIN may be called several different names, with each referring to the same federal ID number issued by the IRS. The specific wording depends on whether the IRS, a bank, a state agency, or a third-party service is using the term.

These are the main EIN synonyms to be aware of:

  • EIN.
  • Employer Identification Number.
  • FEIN.
  • Federal Employer Identification Number.
  • EIN Number.
  • Employer ID Number.
  • Federal Tax Number.
  • Federal Employer ID Number.
  • Federal Tax Identification Number.
  • Federal Tax ID Number.

2. When Should I Get My State Of Maine EIN

You can only apply for your Maine EIN once your LLC is officially recognized as a separate legal entity. Because of this, you must first file your Certificate of Formation documents with the Maine Secretary of State. Then, wait for approval before requesting your EIN. This is also an official IRS requirement.

Additionally, make sure you confirm the number of members before officially forming your LLC. This determines whether you’ll be treated as a single-member or multi-member LLC by the IRS by default. You’ll need to complete additional paperwork if you want to change your LLC membership structure at a later date. I’ve also explained this below.

How To Get An EIN For Your Maine LLC

The IRS offers two main EIN filing methods once you’ve formed your Maine LLC. While each method is free, your chosen method determines your processing time:

  • Online: Your EIN is usually issued immediately after completing your 15-minute application process.
  • Mail/Fax Form SS-4: You must complete Form SS-4 and submit it to the IRS by mail or fax. Mail applications are commonly processed within 4 weeks + mailing time, while fax applications are processed in around 4 business days.

Note: You can use any of the application methods if you’re a U.S. resident with a valid SSN or ITIN. However, I strongly advise applying online in most cases. It’s the easiest option and typically offers the fastest approval.

1. The IRS Online Application Process (U.S. Citizens And U.S. Residents)

The online EIN application system requires a valid SSN or ITIN. Therefore, this method is only available for U.S. residents. If you’re eligible, this should be your first choice. You will get an EIN instantly after a 15-minute application process.

2. The Mail And Fax Application Process (Non-U.S. Residents)

You must use the offline mail/fax application process if you’re a non-U.S. resident without a valid SSN or ITIN or if you can’t access the online filing system.

In this case, complete Form SS-4 and send it either by:

  • By fax: 855-215-1627 (within the U.S.) or 304-707-9470 (from outside the U.S.).
  • By mail: Send it to the IRS (Attn: EIN Operation), Cincinnati, OH 45999.

The EIN Approval Procedure (EIN Confirmation Letter)

Once your EIN application is approved by the IRS, your LLC will be given an official EIN Confirmation Letter, also known as Form CP-575. This includes your EIN and provides official proof that your LLC now has one for federal tax and employment purposes.

  • Form CP-575 will be immediately available to download if you apply online.
  • You will receive your EIN confirmation letter by mail if you apply using the mail or fax filing methods.

I highly recommend keeping your EIN Confirmation Letter and EIN securely stored with your official business records. You’ll need them to open a dedicated business bank account, file required federal taxes, and complete key compliance and regulatory procedures.

Note: The IRS will NOT issue you a new EIN Confirmation Letter (Form CP-575) if you lose it or forget to download it after applying online.

Therefore, you must request an EIN Verification Letter (Form 147C) from the IRS instead. This holds the same legal standing and is accepted by banks and government agencies. Call the IRS at 800-829-4933 (Monday to Friday, 7 A.M. to 7 P.M. ET) to request a letter. The IRS should help you get it over the phone once you’ve verified your identity and business authority.

Does Your LLC Need An EIN?

Note: As I’ve briefly mentioned above, you must get an EIN if you’re a foreigner without a valid SSN or ITIN. This is because you need one for federal tax identification purposes. This requirement applies regardless of your LLC member number.

Your federal tax classification primarily determines whether or not you legally require an EIN for your LLC. The IRS classifies your LLC as follows by default:

  • Single-member LLCs: Classed as disregarded entities.
  • Multi-member LLCs: Classed as partnerships.

Alongside this, your LLC may choose to be taxed as an S corporation or C corporation if it files the necessary forms with the IRS.

I’ve broken down the key EIN requirements for each group in the sections below.

1. Single-Member LLCs Taxed As Disregarded Entities

Single-member LLCs do NOT technically need to obtain an EIN at the federal level. This is because the owner can report their required federal taxes using their official SSN or ITIN.

However, this is very impractical if you’re looking to carry out efficient business operations. As stated by the IRS, single-member LLCs must get an EIN to hire LLC employees or expand to industries requiring excise tax.

Note: You will need this in Maine for your state tax obligations. I’ve discussed this further in the sections below.

2. Multi-Member LLCs Taxed As Partnerships

Multi-member LLCs must obtain an EIN if they have two or more members and are taxed as partnerships by default. This is the only way for the IRS to recognize your business as a separate taxpayer when completing your federal filing and compliance obligations. This is set under the 26 Code of Federal Regulations (C.F.R) § 301.6109-1(a)(1)(ii)(C).

3. LLCs Taxed As Corporations

According to 26 C.F.R. § 301.6109-1(a)(1)(ii)(C), corporations (S corporations or C corporations) must obtain an EIN to file their corporate tax returns, complete payroll reporting, and meet federal tax compliance.

Why Do You Need To Get An EIN For Your Maine LLC?

Note: While your LLC won’t be penalized for not having an EIN, it will NOT be able to complete several required state and federal filings without one.

Your Maine LLC should obtain an EIN for three main reasons. I’ve explained each of these in more detail in the following sections.

1. State Requirements

You can NOT complete your required state tax registrations and obtain your state tax number without getting an EIN. This has been made clear in the Maine Revenue Services’ official guide.

Note: Although your single-member LLC is taxed as a disregarded entity for federal tax purposes, similar to a sole proprietorship, it remains a separate legal entity under state law. The state of Maine distinguishes single-member LLCs from sole proprietorships in its official filing system.

So when you are an LLC, you must get an EIN before registering your LLC with the Maine Revenue Services.

Your LLC is NOT exempt from filing its required returns to report tax to Maine Revenue Services and paying any tax owed if you fail to complete your required registration. This is the case even if no tax is due.

This increases your risk of:

  • Penalties.
  • Late-payment interest.
  • Back taxes (for amounts that should have been paid).
  • Potential criminal exposure in serious cases.

Example: Many LLCs must apply for a Maine Sales Tax Permit. Operating without one is classed as a Class E crime under M.R.S. § 1754-B(3). This is punishable by up to 180 days (6 months) in jail (§1604) and a fine of up to $1,000 (§1704).

You create several serious federal compliance risks if you attempt to operate your Maine LLC without an EIN. Your EIN is not just a “number” at the federal level. It’s used to identify your LLC for tax filing, reporting, and payment obligations.

a. Failure To Provide A Required Taxpayer Identification Number

The IRS may see your LLC as “noncompliant” if you’re required to file federal tax or informational returns but fail to show a valid EIN.

Example: When filing Form 1099 to report payments to independent contractors, you face multiple penalties under the IRS code if you fail to show a valid EIN:

  1. Filing incorrect or incomplete information returns (IRC § 6721).
  2. Failing to provide accurate payee statements (IRC § 6722).

These penalties are assessed on a “per return” basis. Furthermore, they’ve been adjusted by the IRS for 2026 returns as follows:

  • Standard penalties: Up to $340 per return.
  • Intentional violations: Penalties can rise to $680 per return or 10% of the required amount.

b. Failure To File Returns And Pay Federal Taxes

Your Maine LLC can NOT complete several federal tax functions without an EIN. These include:

  • Filing your federal income tax returns.
  • Issuing or receiving reportable payments.

Under IRC § 6651, your LLC may face several penalties if you fail to file your required returns or pay your federal taxes.

Note: The IRS has increased the failure to file penalty to be as follows in 2026:

  • Multi-member LLCs taxed as partnerships by default: $255 per partner per month.
  • LLCs taxed as corporations (even if no tax is due but a return is required): 5% of unpaid tax per month (up to 25%) + additional penalties.

c. Failure To Comply With Federal Withholding Obligations

Note: Your employee withholdings are classified as trust fund taxes. Therefore, the money withheld from LLC employees’ paychecks and held by your LLC in trust must be remitted in full and on time using your EIN.

Your LLC can NOT complete the following tasks without a valid EIN:

  • Pay its required employment taxes.
  • Report employee withholding amounts.
  • Register payroll tax accounts.

Failing to withhold or remit required employment taxes may expose your LLC to fines and potential imprisonment under IRC § 6672.

3. Prevent Operational Limitations

Acquiring an EIN for your LLC when operating allows you to function using the U.S. tax and financial system. It’s required by lenders, banks, and state tax agencies to identify your LLC for credit, accounting, and reporting purposes.

Your LLC can NOT function properly without one. In this case, you need to rely on personal workarounds, all of which weaken the separation between you and your LLC.

Furthermore, this increases your audit and compliance risks, exposes your personal finances, and reduces your limited liability protection. Examples include using your personal bank account for business transactions and using personal credit to access business financing.

  • Hours: Monday to Friday, 7:00 A.M. to 7:00 P.M. ET (ensure you call at 7:00 A.M. ET when the phone lines open to avoid long waiting times).

When prompted, follow these steps to be connected to a live agent:

  • Press 1 for English (or 2 for Spanish).
  • Press 1 again for EIN-related questions.
  • Press 3 if you already have an EIN but can’t find it.

Tip: Ensure you press “3″ regardless of your problem. This is the only way to reach a live representative.
