However, you must complete several additional compliance and operational tasks before you can operate as a fully-functioning business.

The Louisiana EIN Overview

Your EIN is a nine-digit federal identifier issued by the IRS that separates your tax and legal identity from your personal information. You can apply for your EIN completely free using the official IRS website, regardless of your chosen filing method.

Obtaining your EIN in Louisiana lets you:

If you’re a foreigner forming an LLC in the state, you’re required to obtain an EIN when operating. This is because the IRS uses it as your primary business identifier for tax purposes.

While not all U.S.-owned LLCs need to obtain an EIN, I strongly advise getting one to ensure smooth and efficient long-term business operations. I’ve discussed who should register for an EIN and why in the sections below.

Notes: Your Louisiana State Tax Identification Number is NOT the same as your Louisiana EIN. Your tax ID number is issued by the Louisiana Department of Revenue for state-level tax obligations, while your EIN is issued by the IRS for federal tax reporting.

1. Common Names For Your Louisiana EIN

Your EIN may be referred to by several different names, which can confuse when completing your filing procedures. However, these all refer to the same nine-digit federal identification number issued by the IRS.

2. The Best Time To Obtain Your Louisiana EIN

Your chosen filing method dictates your exact timeline. Filing your LLC online or by mail determines whether you’ll get your EIN before or after the state approves your business.

If you choose a mail-in paper filing, you must wait until the state approves the company before you get your EIN. The online process completely changes that order.

For an online filing, you’ll first reserve your LLC name and then come back to this article to secure your EIN. Only after completing those steps can you finish the online Articles of Organization filing process.

How To Get An EIN For Your Louisiana LLC

Obtain your Louisiana EIN from the IRS using two main filing methods:

  1. Online (via the official IRS website): This is the best method for U.S. residents with a valid Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN).
  2. Form SS-4 (via fax or mail): This method must be used by non-U.S. residents without a valid SSN or ITIN.

1. How To Obtain Your EIN As A U.S. Resident

If you’re a U.S. resident with a valid SSN or ITIN, this is the quickest and easiest way to obtain your EIN. You must submit your application via the official IRS online application portal. The online application process is simple and takes around 15 minutes. Once approved, your EIN will be issued immediately.

Note: You can also apply for an EIN by fax or mail if you’re a U.S. resident with a valid SSN or ITIN. However, these methods take significantly longer and offer no additional advantages. Therefore, you should only use them if you can’t apply using the official IRS online system.

2. How To Obtain Your EIN As A Non-U.S. Resident

If you’re a non-U.S. resident without a valid SSN or ITIN, you need to complete Form SS-4 and file it by fax or mail. Use the provided link or click the download button on the right-hand side of the screen to access your form.

Your chosen application method determines your EIN processing time. This may also be influenced by the current IRS workload:

  • Mail applications: Up to 4 weeks + mailing time.
  • Fax applications: Approximately 4 business days.

EIN Confirmation Letter

The IRS will issue you an EIN Confirmation Letter (Form CP-575) once your application has been approved. Your chosen filing method determines how you’ll receive your letter:

  • Online applications: You can download your letter immediately once your application is approved.
  • Mail or fax applications: You will be sent your EIN Confirmation Letter by mail. This takes several weeks, depending on the mailing time and IRS workload.

I highly recommend keeping your EIN Confirmation Letter with your official business records in a safe space. It will be required when opening a dedicated business bank account, filing your federal taxes, and completing important financial and administrative tasks.

Tip: You will NOT be given a replacement copy if you lose your original EIN Confirmation Letter (CP-575). Instead, you need to request an EIN Verification Letter (Form 147C) from the IRS.

Both letters hold the same legal authority. Furthermore, they’ll be accepted by government agencies, banks, and licensing authorities as official proof that you have a valid EIN.

Do You Need An EIN For Your Louisiana LLC?

Important: You must obtain an EIN as a foreign individual forming a U.S. LLC. This applies whether you’re a single-member LLC or a multi-member LLC. This requirement is because you don’t have an SSN or ITIN to complete your required IRS tax filings.

Your Louisiana EIN requirements are primarily determined by two things:

  1. Your IRS tax classification.
  2. Your LLC ownership structure.

The state tends to follow the same federal standards, with your LLC being placed into one of the following tax classifications:

  1. Single-member LLCs: Taxed by default as disregarded entities.
  2. Multi-member LLCs: Taxed by default as partnerships.
  3. You can also elect to be taxed as a C corporation or an S corporation if you file the necessary forms with the IRS.

1. Multi-Member LLC

You must obtain an EIN if your LLC has multiple members. This is required as your LLC is taxed as a partnership by default. Under 26 C.F.R. § 301.6109-1(a)(1)(ii)(C), you’re legally required to use your EIN as your federal tax identifier.

2. Single-Member LLC

You may NOT need an EIN if you’re a single-member LLC treated as a disregarded entity according to official IRS rules. However, your LLC faces several long-term operational risks if you use your SSN as your main business identifier.

  • Increased privacy risk: Your personal information has a higher chance of being exposed.
  • Poor liability separation: You weaken the separation between your business assets and personal finances.
  • Constrained business operations: Your LLC can NOT hire employees or open a dedicated business bank account.

Because of this, I highly recommend obtaining an EIN when operating as a single-member LLC in Louisiana.

Obtaining an EIN is a mandatory requirement if you’re a single-member LLC that elects to be taxed as an S corporation or a C corporation.

3. LLCs Taxed As Corporations

You must obtain an EIN if you elect to be taxed as a C corporation or an S corporation. This applies regardless of whether you’re a single-member LLC or a multi-member LLC.

You need an EIN to:

  • Process corporate tax returns.
  • Manage LLC payroll.
  • Enforce federal tax compliance.

Under 26 C.F.R. § 301.6109-1(a)(1)(ii)(C), this rule follows the same federal standards applied to multi-member LLCs.

Why Is It Important To Obtain An EIN For Your Louisiana LLC?

If you fail to obtain an EIN, the state of Louisiana will NOT impose any direct penalties. Instead, you’ll be given indirect state-level and federal-level penalties if you try to operate without one.

1. State-Level Penalties

Any Louisiana business wanting to sell or lease taxable goods and services in the state must register with the Louisiana Department of Revenue before completing its state-level tax obligations. One of the most common ones is the Sales and Use Tax.

You can do this online using the official LATAP portal. This requires an EIN to complete your registration process.

Not registering for remitting your required Sales Tax can trigger the following penalties under RS 47:1602:

  • Late payment penalty: 5% of the unpaid tax amount applies to every 30-day period that your tax remains unpaid. This can reach a maximum of 25%.
  • Late filing penalty: 5% of your tax due applies to every 30 days that your return is late. This can also reach a maximum of 25%.
  • Penalties are collected like taxes: All penalties are treated as part of your tax owed and therefore enforced in the same way.
  • Partial payment penalty: You face additional penalties if your return is filed but NOT fully paid.
  • Risk to tax incentives: Your state tax incentives or exemptions may be suspended if your taxes remain unpaid following a final judgment.

2. Federal Penalties

Alongside the indirect state-level penalties discussed above, you may face several federal enforcement penalties if you operate without a valid EIN. Alongside this, your LLC may face administrative delays.

I’ve discussed the main federal penalties in the sections below:

a. Failure To Provide A Required Taxpayer Identification Number To The IRS

The IRS sees it as a “failure to provide the required taxpayer information” if you need to file your information or federal tax returns but don’t have an EIN.

In this case, the following laws apply:

  • Internal Revenue Code (IRC) § 6721: You face IRS penalties for incorrect or incomplete informational returns.
  • IRC § 6722: Penalties can be imposed for giving incorrect or incomplete payee statements to recipients. For example, business contractors.

Most violations tend to occur when completing your Miscellaneous Information (Form 1099) without a valid EIN. As you’re technically failing to submit complete information to the IRS and your contractor, this triggers both penalties, doubling your federal consequences for one reporting error.

With penalties assessed on a per-return basis, your financial exposure can quickly escalate:

  • Returns filed without a correct/valid EIN: A standard $340 penalty per return.
  • Intentional omissions: A $680 penalty per return or 10% of your reported amount.

If you attempt to submit multiple informational returns without a valid EIN, your LLC faces significant cumulative penalties.

b. Failure To Properly File And Pay Federal Taxes (Substantive Tax Violations)

Without a valid EIN, your LLC can NOT properly file, report, or pay taxes under its correct tax identity. When this happens, it creates serious federal tax compliance issues:

  • Your LLC can NOT submit federal tax payments on time using its official name.
  • Your LLC can NOT complete its required federal income tax returns if forms require a valid EIN.
  • Any tax filings submitted without a valid EIN are seen as inaccurate or invalid.
  • Your LLC can NOT issue or receive reportable payments. Therefore, it can NOT comply with federal reporting rules.

Under IRC § 6651, the IRS may impose further penalties if your return is filed late or contains incomplete/inaccurate information. This applies even if the issues stem from incorrect or missing taxpayer ID information.

If this happens, your penalty calculations are based on your LLC’s size and structure:

  • Multi-member LLCs (taxed as partnerships): A $225 penalty per partner per month. This is applied to 2026 filings.
  • LLCs taxed as corporations: A 5% penalty applies to unpaid tax for each month that your return is late. This reaches a maximum of 25%.

Penalties may still apply if you need to submit a federal return, even if you owe no tax. Therefore, NOT having an EIN creates federal compliance obligations and tax violations, with both having financial consequences.

c. Failure To Comply With Federal Withholding Requirements

Your LLC must properly withhold, report, and pay federal employment taxes if it has employees. If you fail to meet these obligations, you expose your LLC to serious personal liability.

The IRS can then impose penalties on those responsible for collecting, accounting for, and paying withholding taxes if they knowingly fail to do so. This includes significant financial penalties and potential criminal consequences under IRC § 6672.

Because your LLC can’t perform its necessary payroll and withholding functions without a valid EIN, these penalties stem from NOT getting one. Examples of required payroll and withholding functions that can NOT be performed include:

  • Reporting employee wages and withholding information accurately.
  • Registering for necessary federal payroll tax accounts.
  • Using your correct tax identity to submit your required withheld employment taxes.

Your LLC can NOT comply with federal payroll requirements without completing these steps. This causes serious IRS enforcement actions and trust fund recovery penalties.

3. Operational Risks

Your business structure and legal protections are weakened if you attempt to operate your LLC without a valid EIN. This leads to several avoidable financial and compliance issues, including:

  • The chance of identity theft is increased as your personal information is exposed.
  • You face complicated bookkeeping as you lose the clear financial separation between your personal finances and business assets.
  • You’re unable to establish credit in your LLC’s name or open a dedicated business bank account.

Once you obtain a valid EIN, your LLC has a distinct federal tax identity. This supports accurate bookkeeping processes and preserves your limited liability protection provided by your LLC business structure.

Is an EIN free?

Yes, obtaining your Louisiana EIN is completely free when using the official IRS website. This is regardless of your chosen application method (online, by mail, or by fax). Third-party websites may charge a small fee. However, I don’t recommend using them.

How to find an EIN?

You can find your EIN on your official EIN Confirmation Letter (Form CP-575). The IRS will issue this once your application has been officially approved.

You will NOT be given another Form CP-575 if you misplace your letter or don’t download it. If this happens, you must contact the IRS to request an EIN Verification Letter (Form 147C). As it holds the same standing as your original confirmation letter, you can use it as official proof that your LLC has been assigned an EIN. It will be accepted by banks, lenders, vendors, and official government agencies.

How do I get a Louisiana tax ID number?

The easiest way to register your LLC with the Department of Revenue is to use the online LATAP portal. This requires an EIN to complete, and you’ll be given a Louisiana Tax ID Number once complete.
