Your EIN may be referred to by several different names, with each one meaning the same federal IRS identification number. I’ve listed the common EIN names in the table below so you don’t get confused when completing your filing.

2. When Should You Obtain Your EIN In Hawaii?

Don’t apply for your EIN until your LLC formation documents (Articles of Organization) have been approved by the DCCA. You may face filing delays and rejections if you apply beforehand. This happens when your filing information doesn’t match.

I also highly recommend confirming the number of LLC members before completing your application. This ensures that you have accurate filing information, which reduces the risk of additional reviews. This is especially important when determining your tax classification and compliance.

How To Get An EIN In Hawaii For LLCs

You can obtain your EIN from the IRS using two main filing methods:

  1. Online via the IRS website: This method is used by U.S. residents with a valid Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN).
  2. By fax or mail using Form SS-4: This method is used by non-U.S. residents without an SSN or ITIN.

1. Obtaining Your EIN As A U.S. Resident

Applying for your EIN online is the best option if you’re a U.S. resident. To complete this, you need to use the official IRS online application portal and have a valid SSN or ITIN.

The process is fairly straightforward and takes around 15 minutes to complete. Once filed, your EIN should be issued immediately.

Note: While U.S. residents can use the mail/fax application method, it takes much longer to process and offers no additional benefits. You should only use these methods if you can NOT apply using the official IRS online filing system.

2. Obtaining Your EIN As A Non-U.S. Resident

You must complete your EIN application by mail or fax if you’re a non-U.S. resident without a valid SSN or ITIN. Complete Form SS-4 and submit it by fax or mail. You can access your form using the provided link or by clicking the button on the right-hand side of the page.

Your chosen application method determines your EIN processing time:

  • Mail applications: Up to 4 weeks + mailing time.
  • Fax applications: Approximately 4 business days.

The IRS will give you an EIN Confirmation Letter (Form CP-575) once your application has been approved by the IRS. Your letter will be sent to you based on your chosen filing method:

  • Online applications: Your confirmation letter is issued immediately once your application has been approved.
  • Mail/Fax applications: You will be sent your confirmation letter by mail. This can take several weeks, depending on your mailing times and IRS workload.

I highly recommend storing your EIN Confirmation Letter with your official business records in a safe place. You will need it when opening a dedicated business bank account, filing federal taxes, and completing your mandatory financial and administrative tasks.

Tip: You will NOT get a replacement copy from the IRS if you lose your original EIN Confirmation Letter (CP-575). Therefore, you need to request an EIN Verification Letter (Form 147C).

Both of these documents hold the same legal authority and will be accepted by government agencies, banks, and licensing authorities as official proof of your valid EIN.

Do You Need An EIN For Your Hawaii LLC?

Important: You must obtain an EIN if you’re a foreign individual forming a U.S. LLC (single-member or multi-member). This is because you don’t have an SSN or ITIN to complete your tax filing required by the IRS.

Your LLC ownership structure and IRS tax classification determine your Hawaii EIN requirements. The state usually follows the same federal standards, meaning that your LLC typically falls into two main default tax classifications:

  1. Single-member LLCs: Taxed as disregarded entities by default.
  2. Multi-member LLCs: Taxed as partnerships by default.

Note: You can elect to be taxed as an S corporation or C corporation if you file the correct forms with the IRS.

1. Multi-Member LLC

You need to obtain an EIN if your LLC has more than one member. This is due to multi-member LLCs being taxed as partnerships by default. In this case, you’re legally required to use your EIN as your federal tax identifier under C.F.R. § 301.6109-1(a)(1)(ii)(C).

2. Single-Member LLC

If you’re a single-member LLC classed as a disregarded entity, you may NOT need to get an EIN under official IRS rules. However, using your SSN creates several long-term operational risks:

  • Higher privacy risk: Your personal information may be exposed.
  • Weaker liability separation: The separation between your personal finances and business assets is weakened.
  • Constrained business operations: Your LLC can NOT open a dedicated business bank account or hire employees.

Therefore, I highly recommend obtaining an EIN when operating in Hawaii.

3. LLCs Taxed As Corporations

You must obtain an EIN if you choose to be taxed as a C corporation or an S corporation. This applies regardless of whether you’re a single-member LLC or a multi-member LLC.

The IRS needs your EIN to process corporate tax returns, manage LLC employee payroll, and enforce federal tax compliance. This follows the same federal regulations applying to multi-member LLCs under 26 C.F.R. § 301.6109-1(a)(1)(ii)(C).

Why Does Your Hawaii LLC Need An EIN?

Your LLC will NOT face direct penalties for failing to acquire an EIN in Hawaii. However, you face several secondary state-level and federal penalties if you operate without one. I’ve discussed this in more detail below.

1. State-Level Penalties

You require an EIN for several mandatory state filings. For example, anyone receiving income when conducting business in Hawaii must register for a General Excise Tax License (GET).

You must register your LLC with the Hawaii Department of Taxation to get this license. To do this, you have to use their online portal and provide your business EIN.

Your LLC may be imposed with the following fines for operating without the required GET License under HRS §237-9:

  • A fine of up to $500.
  • Cash-based businesses operating without a license face a higher mandatory fine. This ranges from $500 to $2,000.

Note: These fines are imposed alongside any penalties imposed under other laws. They do NOT replace other penalties.

2. Federal Penalties

Alongside indirect state-level penalties, your LLC may face federal penalties if you try operating without an EIN. If this happens, you may also face administrative delays. I’ve discussed the main ones in the following sections.

a. Failure To Provide A Required Taxpayer Identification Number To The IRS

If you don’t have an EIN but need to file your federal tax or information returns, it will be seen as a “failure to provide the required taxpayer information” by the IRS.

In this case, the following laws may apply:

  • Internal Revenue Code (IRC) § 6721: The IRS may impose penalties for incorrect or incomplete informational returns.
  • IRC § 6722: You may face penalties if you provide incorrect or incomplete payee statements to recipients. For example, business contractors.

Violations commonly occur when completing your Miscellaneous Information (Form 1099) without a valid EIN. This triggers both of the above penalties, as you’ve technically failed to complete the required information with the IRS and your contractor. This doubles your federal consequences, even though it’s just one reporting error.

Your penalties are assessed on a per-return basis rather than per filing period. Therefore, your financial exposure can quickly escalate:

  • Returns filed without a correct/valid EIN: A standard $340 penalty per return.
  • Intentional omissions: A $680 penalty per return or 10% of the reported amount.

Therefore, your LLC faces significant cumulative penalties if you try to submit multiple returns without a valid EIN.

b. Failure To Properly File And Pay Federal Taxes (Substantive Tax Violations)

Without an EIN, your LLC can not properly file, report, or pay taxes under its correct tax identity. This may cause serious federal tax compliance issues:

  • You can’t complete your required federal income tax returns if your IRS form needs a valid EIN.
  • You can’t submit federal tax payments on time using your LLC’s official name.
  • Tax filings submitted without a valid EIN may be viewed as invalid or inaccurate.
  • Your LLC can’t issue or receive reportable payments and comply with federal reporting rules.

Under IRC § 6651, the IRS may impose further penalties if your return is filed late or contains incomplete or inaccurate information. This applies even if the issues stem from your taxpayer ID details being incomplete or missing.

Your LLC’s size and structure determine your penalty calculations:

  • Multi-member LLCs treated as partnerships: $5 penalty per partner per month applied to 2025 filings.
  • LLCs taxed as corporations: 5% penalty on unpaid tax for each month that your return is late (up to a maximum of 25%).

Penalties may still apply if you need to submit a federal return but owe no tax. Therefore, you commit several federal tax and compliance violations if you fail to obtain your EIN, both of which have financial consequences.

c. Failure To Comply With Federal Withholding Requirements

Your LLC must properly withhold, report, and pay Federal Employment Taxes if your LLC has employees. This exposes your LLC to serious personal liability if you fail to meet these mandatory obligations.

In this case, the IRS can impose penalties for failing to collect, account for, and pay withholding taxes if you know you need to. This includes significant financial penalties and potential criminal consequences under IRC § 6672.

Because your LLC can’t perform the necessary payroll and reporting functions without a valid EIN, these penalties stem from trying to operate without one. Examples include:

  • Registering for your applicable federal payroll tax accounts.
  • Reporting accurate employee wages and withholding information.
  • Submitting required withheld employment taxes using your correct tax identity.

Therefore, your LLC is unable to comply with federal payroll requirements if these steps can’t be completed. In this case, you face serious IRS enforcement actions and trust fund recovery penalties.

3. Operational Risks With No EIN

If you attempt to operate your LLC without a valid EIN, you face avoidable compliance and financial issues that weaken your business structure and legal protection. These include:

  • Exposing your personal details to identity theft and fraud.
  • Reducing the financial separation between your financial assets and business finances.
  • Not being able to open a dedicated business bank account or establish credit in your LLC’s name.

With a valid EIN, your LLC has a distinct federal tax identity. Furthermore, you can perform accurate bookkeeping processes and operate with limited liability protection provided by your business structure.
