2. Apply By Mail Or Fax (For Non-U.S. Residents)

Bad news unfortunately if you’re a non-U.S. resident without an SSN or ITIN. You can stil get an EIN, but it’ll take much longer. You’ll need to do things the old fashioned way and apply offline using a paper form.

To do this, fill out Form SS-4 and send it to the IRS. Unlike the online process, things are abit slower. Processing times range from a few days to several weeks, including delivery time and the review.

There’s several things that you should think about before applying for your EIN. Ignore them, and you’ll quickly face filing delays and potential rejection. Not good news if you want to get things off the ground.

First, make sure you confirm your LLC member number. If things ever change, you’ll need a new EIN. Lets say your LLC converts from a single-member to a multi member LLC or transfers ownership; you’ll need a new one.

Alongside this, you can only have one EIN at a time. If you’ve got more, contact the IRS immediately to rectify the issue. Backing onto this, your EIN must be your own and no one elses. Always apply for a new EIN and never try to use someone elses.

How Quickly Can You Get An EIN From The IRS?

Apply online and things will be completed before you know it. You’ll get your shiny new EIN within around 5–10 minutes, once your information is verified.

For other methods, the IRS processing times vary. It typically takes 4–6 business days or several weeks, depending on how you submit your application.

Note: The online option is the fastest. On the other hand, mail and fax applications take longer and are mainly used by non-U.S. residents or special cases.

1. EIN Approval (EIN Confirmation Letter)

After you obtain your EIN for your LLC from the IRS, you’ll get an EIN Confirmation Letter (CP 575). This is your official proof that your EIN has been issued.

How this letter is delivered will vary according to your EIN application method. If you filed online, you can download the letter immediately after approval. However, if you applied by mail or fax, you will receive your letter from the IRS by mail.

On top of this, you’ll pay a 24% penalty according to 26 U.S.C. §3406(a)-(b) for backuo withholding for unreported payments and face pesonal liability for unpaid payroll taxes as outlined in 26 U.S.C. §6672.
