Alabama EIN: A Quick Overview
An EIN is a unique nine-digit business number issued by the IRS that allows your business to be identified for tax purposes. An Alabama EIN is required to open a business bank account, hire employees, file taxes, and maintain accurate financial records.
1. Alternative Names For An EIN
An Employer Identification Number can also be referred to as an:
- EIN.
- Employer Identification Number.
- FEIN.
- Federal Employer Identification Number.
- Federal Tax Identification Number.
- Federal Tax ID.
- EIN Number.
- FEIN Number.
2. How Much Does An EIN In Alabama Cost?
Applying for your EIN directly through the official IRS website is free of charge. This also applies to when you file your application by mail or fax (You’ll need to pay the mailing fee). If you find services that charge a fee, these are not associated with the IRS and do NOT need to be used.
Tip: I recommend that you file on the official IRS website and avoid using third-party websites. This ensures that your application is processed safely and according to federal requirements.
3. When Should You Get An EIN?
Before applying for your EIN with the IRS, you need to wait until your LLC is officially recognized by the state. This means that you need to wait until your Certificate of Formation is officially approved by the Alabama Secretary of State.

Doing this ensures that your business name and formation details match across both documents. If you apply too early, your documents can be mismatched if your LLC formation filing is rejected or needs editing.
In this case, your original EIN submission would become invalid, and you would need to cancel your application and reapply. This costs valuable time and money, making it a good idea to apply once you’ve received official confirmation.

Obtaining an EIN for your Alabama LLC is a fairly simple process managed directly by the IRS. Apply for your EIN in Alabama online through the IRS website, by mail using Form SS-4, or by fax. This should be done as soon as your LLC’s Certificate of Formation has been approved.
While the issuing process works the same nationwide, the filing method depends on your citizenship status.
- U.S. citizens can apply online and be issued an EIN within minutes. This requires a Social Security Number (SSN) or an Individual Taxpayer Identification Number (ITIN).
- Non-U.S. citizens must apply by mail, fax, or phone. The mail and fax applications require you to complete Form SS-4.
1. Applying For An EIN Online (U.S. Citizens)
You should apply for your EIN using the IRS online application system if you’re a U.S. resident with a Social Security Number (SSN) or an Individual Taxpayer Identification Number (ITIN). This is the easiest and most efficient application method.
You’ll receive an EIN Confirmation Letter (CP-575) immediately once you’ve completed the 15-minute application process. This acts as official proof that your LLC now has a Federal Tax ID (EIN).
You can read my step-by-step guide on How To Apply For An EIN Online for detailed instructions.
2. Applying For An EIN Offline (Non-U.S. Residents)
You must apply for your EIN using an offline method (by mail or fax) if you’re a non-U.S. resident without an SSN or ITIN. You cannot use the online EIN application system without these. Instead, you must complete and submit Form SS-4 to the IRS.
To complete Form SS-4, you must provide:
- Your legal business name (As stated on your Certificate of Formation).
- The name of the responsible party (Whoever is applying).
- Your business type (LLC, sole proprietorship, corporation, etc).
- Your official business start date.
- Your primary business activity.
- Your main reason for applying (e.g., starting a new business, hiring employees).
Note: This application method takes much longer than the online filing process. Fax applications take approximately 4 business days, while mail applications take 4–6 weeks. However, this is the only available processing method for foreign applications wanting to form an Alabama LLC.
Read my instructions for Getting An EIN Without An SSN Or ITIN if you’re a foreign business owner and require extra help.

- Apply for business licenses: Most local and state agencies require an EIN before applying.

In addition to these state/county license requirements, many municipalities require their own business licenses.
Tip: Check with the city to determine if your LLC requires a municipal license, especially if it operates within a city’s jurisdiction.
2. Federal Tax Obligations
All Alabama LLCs are required by the IRS to acquire and maintain an EIN for federal reporting. This requirement is separate from your LLC formation process and state regulatory requirements.

- Potential personal liability for unpaid payroll taxes 26 U.S.C. §6672.
b. Foreign-Owned Or Foreign-Controlled LLCs
If you’re a foreign business owner forming an LLC in Alabama, you must file Form 5472. In some cases, you’ll also need to file Form 1120 for IRS disclosure.
You cannot perform several business functions without an EIN:
- Open a U.S. business bank account.
- File tax forms.
- Meet disclosure requirements.
Furthermore, you may face a penalty of up to $25,000 per year per entity for failure to comply. This is set under U.S.C. §6038A(d) and 26 CFR §1.6038A-4.
EIN Approval (EIN Confirmation Letter)
You’ll receive an EIN Confirmation Letter (CP 575) once the IRS has accepted your EIN application.
This letter is the official proof that your LLC has been assigned an EIN, meaning you’re officially recognized as an employer.
You’ll receive your confirmation letter depending on your chosen application method:
- Online: Your application is processed immediately. You should be able to download your EIN Confirmation Letter at the end of the application process.
- Mail and fax: Your application can take significantly longer. The IRS will send your EIN Confirmation Letter in the mail.
