An Overview Of The Hawaii Business Name Search
Under the Hawaii Revised Statutes (HRS) §428-105, your LLC name cannot be the same as, or too similar to, the name of any existing registered state business. Alongside this, it cannot conflict with approved fictitious names, reserved names, or registered trade names/trademarks.

How To Do A Business Name Search In Hawaii
1. Access The Portal And Enter Your Desired LLC Name
To begin, navigate to the Business & Documents Search portal. Then, enter your desired LLC name in the search box and click “Search.”
Note: Make sure you leave the search mode dropdown on “Begins with…” Do NOT change it to “Contains.” If you do, you’ll get a lot of irrelevant results.

Keep these tips in mind when performing your search:
- Don’t add a designator (name ending) such as “LLC”, “L.L.C.”, “Limited Liability Company”, etc.
- Leave out periods, commas, and apostrophes.
- Search using uppercase or lowercase letters.
I recommend entering the main words of your desired LLC name when performing your search. For example, if your desired name is “John Doe LLC,” you can enter the following:
- First, search for “John Doe.”
- Then, search for “John.”
Searching this way should catch the potentially similar results.
2. Check Your Search Result
After clicking “Search,” the system should provide a table of results under the search bar with several columns. You only need to focus on the “Name” column to interpret your search results. I will discuss how to do this correctly in the section below.

Interpreting Your State Of Hawaii Business Name Search Results
There are 4 possible outcomes of your Hawaii LLC name search. I’ve discussed how to interpret each one below to help you pick a name that’s truly unique and distinguishable from existing state businesses.
Disclaimer: Performing your business name search and interpreting the results should be used for screening purposes only. You should NOT use them as a definitive method to determine your LLC name availability. The Business Registration Division (BREG) has the final decision.
1. The Search Returns No Results
Your desired LLC name is unique and available to use if your results show “No Business found matching your search.” Following this, run a second search using part of your desired name to confirm your results.
Example: Your desired business name is “Johnnie Does.”
- Your name search returned no results.
- Therefore, you run more searches using “Johnnie” or “Does” to confirm.

2. The Search Returns Names That Are Not Too Similar To Yours
Your desired LLC name is likely available to use if your results show names that are not too similar.
Example: Your desired LLC name is “John Doe”
- Your results show “John Doe Entertainment.”
- Your LLC name is likely still available.

3. Your Exact LLC Name Appears
Your desired LLC name is not available for use if your results return your exact business name. If this happens, another business registered in Hawaii is already using it.

Example: The name “John Baker” appears in your search field and results table (as shown in the picture below). In this case, “John Baker LLC” is not available.

4. A Name That Is Very Similar To Yours Appears In The Results
If your search results show a very similar LLC name, your desired name may or may not be available to use.
Example: Your desired name is “A.R. Johnston LLC.”
- Your search results return the name “AR Johnston LLC.”
- Your name may not be available.

You must understand the state’s naming rules and regulations when choosing a suitable business name. These are set under HRS §428-105 and other state laws. I’ve discussed the main ones in the sections below.

1. Use Mandatory Designators
Ensure that your desired business name contains one of the following designators:
- Limited Liability Company.
- L.L.C.
- Limited Liability Law Company.
- LLC.
- LLLC.
- L.L.L.C.
You can also abbreviate “Limited” to “Ltd.”, and “company” to “Co.”
2. Avoid Prohibited Designators
Your desired name must NOT sound like another business entity besides an LLC. Therefore, you can NOT use the following abbreviations or designators:
- Inc.
- Corp.
- Corporation.
- Incorporated.
- Non-Profit Corporation.
- Non-profit.
- Limited Liability Partnership.
3. Only Use English In Your Name
The letters in your desired LLC name must be letters of the English alphabet. Therefore, you must translate/pronounce your name in English if you’re a foreign entity and your original name is in a foreign language.
Example: Your desired LLC name is in Korean. Make sure you use the English alphabet when submitting your formation documents.
Your name could be “Han River Trading LLC.”
4. You Can’t Use Geographic Words
Your desired LLC name can NOT use ONLY geographic locations or historically registered landmarks. This rule applies even if you add an LLC suffix or other modifiers.
This includes streets, city names, landmarks, or regions. Examples include: “Honolulu”, “Olomana,” “Wailuku”, “Maui”, “Kailua”, “Oahu,” “Diamond Head,” “Aloha Tower,” “Pearl Harbor,” “North Kohala,” “King Street,” “Beretania Street,” “San Francisco,” “Paris,” “Belgium,” and “Hawaii Foreign Trade Zone.”
5. You Can’t Use Postal Service Terms
Your LLC name can NOT include terms reserved for government use, such as “Postal Service” or “Post Office.“
Example: The names “Hawaii Post Office Solutions LLC” or “Island Postal Service LLC” would not be allowed.
6. You Can’t Use Federally Protected Names
Names protected under federal law can NOT be used in your desired LLC name. This includes those associated with national observances or patriotic organizations.
Example: The names “American Legion Services LLC” or “Red Cross Support Group LLC” are federally-protected and will be rejected by the state.
7. Restricted Words
Certain words are restricted or prohibited under Section 16-36-15 of the Hawaii Administrative Rules, unless you have official legal approval. Your application will be automatically rejected if you attempt to use them.

How Can You Make Your LLC Name Unique?
Under Section 16-36-15(b) of Hawaii Administrative Rules, there are some points you need to consider to make your name distinguishable, so that your Articles of Organization will not be rejected.

1. Use Meaningful Word Differences
Your desired name can include different words that clearly change its meaning. However, you must make sure it is NOT likely to cause confusion when spoken aloud.
Example: The name “Ocean View Café LLC” is different from “Ocean View Coffee House LLC.”
2. Try Changing Or Adding Letters
You can create a unique and distinguishable name by adding additional letters (other than just plural or possessive “s”).
Example:
- The name “Bright Line Designs LLC” differs from “Brighter Line Designs LLC.”
- The name “Sunrise Property Group LLC” is NOT the same as “Sunrise Properties Group LLC.”
3. Use Prefixes, Suffixes, Or Modified Word Forms
Create a distinguishable business name by adding suffixes, prefixes, or different versions of a root word.
Example: The name “Tech Advisors LLC” is different from “Technology Advisors LLC.”
4. Rearrange The Word Order
You can change the sequence of words while keeping the same terms to create a unique and distinguishable LLC name.
Example: Change “Consulting and Marketing Island LLC” to “Island Marketing and Consulting LLC.”
Small Changes That Won’t Create Distinguishability
When performing your business name search, you can try to make small changes to your desired LLC name if it’s already taken. However, the state will NOT accept certain methods, as they don’t view them as creating uniqueness and distinguishability. These naming regulations are stated under Section 16-36-15(a) of Hawaii Administrative Rules.

1. Changing Designators
You can NOT make your business name unique by changing only the business suffix. The state will ignore LLC endings when checking name availability.
- Changing “LLC” to “Inc.,” “Corp.,” or “Company.”
- Adding or removing words like “Partners” or “Group.”
Example: Your desired LLC name is “Acme Consulting LLC.” The following business names are NOT seen as unique and distinguishable:
- Acme Consulting Corp.
- Acme Consulting Inc.
- Acme Consulting Partners.
- Acme Consulting Company.
2. Punctuation & Spacing
Your formation application will be rejected in Hawaii if you attempt to make your LLC name unique by using small formatting changes. The state ignores symbols and punctuation when checking if your name is unique. This includes:
- Adding or removing periods.
- Adding or removing commas.
- Adding or removing symbols (ampersands or hyphens).
Example: Your desired LLC name is “Island Trading LLC.” You can NOT use it if any of the following results are shown:
- Island & Trading LLC.
- Island Trading, LLC.
- Island-Trading LLC.
- Island Trading. LLC.
3. Plural Forms Or Possessive Words
Using possessive or plural word variations will NOT create distinguishability in Hawaii, meaning your formation filing will be rejected. These changes are seen as being too similar to existing business names. This includes:
- Plural forms.
- Possessive words using apostrophes or ownership terms.
Example: Your desired LLC name is “Island Service LLC.” The following names are still seen as being too similar to your desired name:
- Island Services LLC.
- Island Service’s LLC.
4. Abbreviations & Shortened Words
Don’t try using common abbreviations or shortened word forms to create uniqueness and distinguishability when choosing your desired business name.
Example: You want to name your LLC as “Southeast Landscaping LLC.” You can NOT use it if any of the following names appear in your search results:
- S.E. Landscaping LLC.
- S E Landscaping LLC.
- SE Landscaping LLC.
Tip: Make sure that you search for the abbreviation and the complete word when using the business entity search to check availability if you want to use an abbreviation or word with a commonly used abbreviation.
Example: Search for “Techonoly” and “Tech” if you want to use the abbreviation “Tech” instead of “Technology.”
5. Sound-Alike Or Misspelled Names
Names that only differ by spelling or sound the same are still considered to be identical when checking name availability. Pronunciation matters even if the words look different.
Examples of name changes that won’t work include:
- Swapping words that are commonly confused.
- Using different spellings with the same sound.
Example: You want to use the LLC name “The Flour Shop.” You can’t use it if your search results return the name “The Flower Shop.”
6. Filler Words & Letters
Your name will NOT be seen as unique and distinguishable if you make small word or letter changes. The state ignores common connectors and equivalents. These include:
- Using “a,” “an,” “and,” “the,” “of,” “in,” “at,” “on,” “to,” or “for.”
- Using “n” or “-n-” instead of spelling out “and.”
- Hawaiian equivalents such as “da,” “ka,” “ke,” “na,” or “la.”
For example, if your desired LLC name is “Oceanside Pier Honolulu“, you can NOT use it if the following names appear in your business name search results:
- An Oceanside Pier for Honolulu.
- The Oceanside Pier of Honolulu.
Note: If you want to use the LLC name “Ka Hana Maiau“, you cannot use it if Hana Maiau already exists.
7. Using The Word “Hawaii”
Distinguishability can NOT be created by adding “Hawaii,” “Hawaiian,” or “HI.” Examples of changes that won’t work include:
- Adding “Hawaii” or “HI” at the beginning.
- Adding “of Hawaii” at the end.
- Adding “Hawaiian” at the beginning of the name.
Example: You can NOT use the name “Omni” if the following names appear in your search results:
- Omni of Hawaii.
- Hawaiian Omni.
- Omni of HI.
8. Number Formatting
Changing a number from words to numerals or roman numerals will NOT create distinguishability. In this case, your application may still be rejected. The state treats spelled-out numbers and numerical symbols the same.
Example: Your desired LLC name is “Twenty-Seven LLC.” You can’t use it if the following names appear in your search results:
- XXVII LLC.
- 27 LLC.
9. Sequential Numbers Or Letters
The use of sequential numbers or letters will NOT create a unique business name in Hawaii.
For example, if you want to name your LLC “Acme Development I“, you cannot use it if any of the following results appear:
- Acme Development II.
- Acme Development III.
- Acme Development IV.
10. Duplicate Entity Endings
Your name will NOT be seen as unique if the only difference from existing business entities is the use of an ending or business entity word.
Example: You want to name your LLC “Acme Construction.” You can NOT use it if “Acme Construction Company” already appears on the business name list.
What If My Hawaii Business Name Is Rejected?
The state will explain the reason behind your rejection if your Hawaii Articles Of Organization are not accepted. If this happens, you can simply refile using a modified or entirely different LLC name.
As I’ve stated above, your LLC name can NOT be the same or too similar to any existing business names registered in the state. However, there are exemptions, meaning you can use another business’s name in certain cases:
- The current business owner provides written consent, and you use extra words in the new name to create distinguishability.
- You have a court judgment confirming the legal right to use your desired name in the state.
- Your LLC was formed from a merger or reorganization with that entity.
1. Do You Need To Reserve Your LLC Name?
You do NOT need to reserve your desired LLC name before registering it with the state under HRS §428-106.

However, you can reserve your LLC name for 120 days if you’re NOT ready to form your LLC. This requires you to file Form X-1 (Application for Reservation of Name) via the Hawaii Business Express (HBE) portal.
