The state of Texas provides a business-friendly environment with fewer tax requirements and a strong business infrastructure.
Even so, you must complete several state regulatory and filing requirements before your Limited Liability Company (LLC) can perform full business operations. One of them is the Texas business license.
A Texas business license allows your LLC to operate within a specific industry or location in the state. While Texas doesn’t require a general statewide business license, you must obtain important local and state licenses, permits, and registrations.
Every Texas business is unique. Therefore, I cannot provide step-by-step guidance for each licensing application. Instead, I’ve discussed the general requirements and linked some helpful resources regarding the:

Texas LLC Business License Requirements Overview
As mentioned, a business license authorizes your LLC to legally operate in Texas. For this reason, it is important to obtain all required business licenses before conducting official business to avoid compliance issues and penalties.
There are three main licensing jurisdictions in Texas:
- State licensing: Issued by Texas state agencies and licensing boards
- Local licensing: Issued by cities, counties, or townships where your business operates.
- Federal licensing: Issued by federal agencies and required only for certain highly regulated industries, such as firearms, alcohol, aviation, broadcasting, mining, and transportation.
In terms of license type, business licenses generally fall into two categories:
- General business license: A broad license that applies to all businesses regardless of industry or location.
- Occupational or industry specific license: Required for LLCs operating in regulated industries.
Note: Texas does not require a general statewide business license for LLCs.
Instead, your licensing requirements depend on your business activities and where your LLC operates.
The total cost to obtain all required licenses varies, since each issuing agency sets its own application and renewal fees.

How To Get Texas Business License

Important: Texas does NOT require a general state business license. Therefore, you do not need one to legally operate in the state.
However, your LLC may need an occupational license (Industry-specific license) depending on your type of business activity.
To help you out, I’ve provided some helpful resources and contact points below. Use these to research and apply for your applicable business licenses with relevant agency.
1. Texas Occupational License
As I’ve stated above, you must obtain the necessary Texas occupational licenses if your LLC operates in a regulated industry. Examples include finance, construction, and healthcare. Doing this avoids potential heavy penalties and fines.
You do NOT obtain these licenses from the Secretary of State. They’re only responsible for business entity administration and the formation process, such as forming your LLC and maintaining accurate business records.

Furthermore, you can use the Programs Licensed and Regulated by the Texas Department of Licensing & Regulation to see if your industry or occupation requires Texas licensing.
If you need to see if your LLC requires environmental permits or check information regarding compliance authorization, you can consult the Occupational Licensing and Permits and Registrations listings. These are provided by the Texas Commission on Environmental Quality (TCEQ).

2. The Cost Of A Texas Occupational License
Your Texas occupational license registration fee depends on the issuing agency and your business activity.
You can renew most occupational licenses annually. The relevant licensing board may also set a specific renewal schedule.

The Texas Municipal Business License
Each town, city, and county in Texas may have its own business license rules and requirements. This is in addition to the State-Level Licensing requirements.
In the interest of simplicity, I’ve referred to each one as a “municipality.”
You have two main types of municipal business licenses:
- General business license.
- Industry-specific license.
If your municipality requires a general business license, all LLCs operating in that municipality must obtain a license. This requirement is independent of the type of business activity.
A license or permit may be needed if the municipality issues industry-specific business licenses. This depends on your LLC’s operations.
Example: Your LLC operates a bar, restaurant, or food truck.
- You might need a Food Service License or a Health Permit from your local health department.
Example: Your LLC operates a barbershop or a salon.
- You may need a Cosmetology Establishment License from your operating city.
In addition, Local Zoning/Occupancy Permits may be needed before you can open your business location.
Some LLCs may NOT require a municipal license. This is especially the case for those providing home-based consulting or offering online services.

1. The Cost Of A Municipal Business License
The cost of your Texas municipal business license depends on the nature of your business and the local licensing agency regulations. Therefore, I cannot provide exact fees and costings.
I recommend that you contact your local city or county office to find your specific application fees, payment procedures, and application requirements. During this, ask if your municipal business license must be renewed annually.
Note: Meeting your renewal requirements ensures that your LLC remains in good standing with the local authorities and continues legal business operations.
Penalties For Operating Without Proper Texas Business License
You’re not legally required to obtain a general business license in Texas to perform full business operations. Even so, you must check with your local government or the specific professional licensing board just in case.
Note: Your licensing requirements depend on your business industry, location, and the nature of services offered.
1. State-Level Penalties
You will face serious financial and legal consequences if you attempt to operate without the required licenses.
Example: You offer health care services as a physician without the required medical license.
- You violate the Texas Occupations Code §165.001.
- The Texas Attorney General may impose a civil penalty of $1,000 per violation under Texas Occupations Code §165.101.
- For every day that the violation occurs, it will be considered a separate offense. This may result in significant penalties.

On top of these civil penalties, you may be charged with a Class A misdemeanor for practicing medicine without a license. This is stated under Texas Occupations Code §165.151.

In Texas, a Class A misdemeanor is a serious misdemeanor offense. It’s punishable with a fine of up to $4,000, one year in county jail, or both.
2. Municipal-Level Penalties
You must perform your proper due diligence before operating your Texas LLC. Every city and country in Texas has different licensing requirements. If you don’t comply, you’ll be faced with potential fines, penalties, and enforcement actions.
Under Texas Local Government Code §54.001, the state can authorize the municipality to impose a fine of up to $500 for local ordinance violations. However, specific penalties vary depending on the jurisdiction.

In addition to this, some municipalities may pursue civil or, in some cases, criminal penalties. This depends on the nature of your business activity and the severity of your violation. Because of this, you should always acquire and maintain the proper municipal licenses.
What Is The Texas Sales Tax License?
Your LLC may be required to collect Sales Tax and file a Sales and Use Tax Return application if you sell products to Texas consumers. In this case, you must register with the Texas Comptroller of Public Accounts for a Sales Tax Permit.
Note: You must complete this requirement regardless of whether you sell products online or from a physical Texas location.

What Is The Texas Resale Certificate?
Your LLC must obtain a Resale Certificate (Reseller Permit) if you buy goods for resale in Texas. This allows you to purchase tax-free items for resale to Texas customers. However, the items must be sold in the normal course of business.

The Main Federal Business Licenses
You only need a Federal Business License if your LLC operates in a highly-regulated business industry. Use the Small Business Administration’s Licenses and Permits page for a complete list of industries requiring federal licensing.

If you don’t operate in one of these highly-regulated industries, you do NOT need to obtain a Federal business license. You just need to acquire an EIN from the Internal Revenue Service (IRS). This allows you to file federal taxes and submit local tax registration and business licensing applications.

Therefore, there is no statewide registration cost because you’re not required to get a general business license. But you may need additional licenses, depending on your industry and location. Their fees are based on the type of license needed and the specific licensing agency.
The state of Texas does NOT require you to get a general business license. However, you still need to obtain the necessary permits, licenses, and certificates issued at the local, state, and federal levels, depending on your business operations.
The answer is no, it is not. Forming an LLC officially establishes your business as a separate legal entity. On the other hand, a business license gives the LLC permission to sell certain services, products, and operate in a specific industry.
