Tennessee Business License Overview
Note: Tennessee does NOT issue a general business license. Instead, your LLC’s licensing requirements depend on where it operates and the industry in which it conducts business.
To obtain all required licenses, you must contact the appropriate state, local, or federal agencies. I will provide helpful contact resources below.
A business license in Tennessee allows your LLC to perform full business operations in a certain location or within a specific industry.
Business licensing authority is split across three distinct levels in Tennessee:
- State licenses: These are issued by Tennessee agencies and are generally needed for regulated professions.
- Municipal business licenses: These are issued by cities and counties and are commonly required for most businesses. These include small and home-based businesses.
- Federal licenses: These are required for specific industries regulated at the federal level.
Generally speaking, most Tennessee LLCs fall into these two categories:
- General business licenses: This is the type of license that LLCs need to get, regardless of their business location and activity.
- Industry-specific or occupational licenses: These are based on your business’s services and activities.
The total cost of required licenses varies because each issuing agency sets its own initial and renewal fees. For some LLCs, the total licensing cost may be $0 if no licenses are required.

Acquiring your applicable Tennessee business licenses is an important step to operating your LLC legally while maintaining compliance with state and local requirements.
In the following sections, I’ve discussed how to get a business license in Tennessee.
1. Tennessee State General Business License
There is NO statewide general business license requirement in Tennessee.
Because of that, you have NO state-level application process or renewal requirements.
However, you still need to obtain one or more state-issued occupational licenses if you operate in a regulated profession or industry.
Alongside this, you need to register for business tax with the Tennessee Department of Revenue, which I will cover further below.
2. State Occupational Licenses
Your LLC operating in Tennessee must obtain occupational licenses depending on business activities.
The Tennessee Department of Commerce & Insurance provides Licensing & Regulations resources that outline the industries and professions that are regulated at the state level. This helps you determine if your LLC falls into the licensing category.
You can also check the list of Regulatory Boards to see if your industry or occupation needs a business license in Tennessee.
Finally, you can contact the Tennessee Department of Commerce & Insurance for guidance if you have general questions regarding your occupational licensing requirements. Or you can contact the Regulatory Board or Commission directly.
Note: The Tennessee Secretary of State does NOT issue Tennessee business licenses. Their role is limited to your business entity administration processes, including your LLC formation obligations and recordkeeping. Occupational licenses and permits are issued by agencies regulating specific professions.
Tennessee Business Tax Registration
Anyone doing business in Tennessee must register a Tax Account and pay the state-level business tax under Tenn. Code Ann. § 67-4-704, unless a specific exemption applies.

To do so, you use the Tennessee Taxpayer Access Point (TNTAP), the state’s official online portal, to complete the required registrations associated with your Tennessee Business License online compliance, with a fee of $15 for each business location.
- Sales tax license: This allows your LLC to collect and remit sales tax when selling taxable services or goods in the state.
- Business tax (Gross receipts tax): This is based on gross receipts for the privilege of doing business in the state, applying to most LLCs.
- Other state taxes: These are based on your specific business activities and operating methods.

How To Obtain A Tennessee Municipal Business License
Tennessee municipal business licenses are issued by local governments, including cities and counties. While different jurisdictions use different terms (city, town, county), I’ve referred to each one as a “municipality” in the interest of simplicity.
You may encounter two main types of municipal business licenses:
- General business licenses: These apply to most LLCs regardless of their operating industry.
- Industry-specific licenses: These apply to LLCs operating in regulated fields at the local level.
With your license requirements depending on your location, I suggest contacting the relevant municipality to confirm your local licensing rules, renewal schedules, and application steps.

You should also confirm if your city or county has adopted a local business tax in addition to your licensing requirements. While this is not a business license, you may need to register and pay for it each year to keep your good standing at the municipal level.
How Much Is A Business License In Tennessee?
Depending on your location, business activities, and business size, you may need only a local business license, a state occupational license, or both. As a result, your total costs vary.
You can expect the following costs:
- Local and occupational license fees: Range from $50 to over $1000, depending on your issuing authority.
- Renewal fees: Range from $25 to several hundred dollars.
I highly recommend confirming your exact costs with your applicable local municipality or state agency due to this variety. This helps you budget correctly and avoid potential compliance errors.
Some businesses may not require any licenses. If this is the case, your total cost is $0.
Why Do You Need A Business License In Tennessee?
You must obtain your required business licenses to operate legally in Tennessee under Tenn. Code Ann. § 67-4-723. Disobeying the rules makes you face serious legal, financial, and operational consequences at both the local and state levels.

1. Penalties For Not Obtaining Professional Licenses
Operating without a required state occupational license can lead to penalties that vary by industry and regulatory authority.
Enforcement actions may include civil penalties imposed by any board under the Division of Regulatory Boards, as authorized by Tenn. Code Ann. § 56-1-308.
- $1,000 per violation.
- Each day the violation continues is treated as a separate offense.

Some professions face more severe consequences due to the nature of the work.
Example: Contractors engaging in unlicensed contracting are classified as causing a Class A misdemeanor under Tenn. Code Ann. § 62-6-120. In this case, potential penalties include:
- A civil penalty of up to $5,000 per offense.
- The inability to receive a license for six months.
- Limited payment recovery. This means that the contractor can NOT recover more than the documented expenses, nor sue for the full contract value.

Example 2: Real estate professionals acting as a real estate broker or agent without a license face the following penalties under Tenn. Code Ann. § 62-13-110:
- A penalty equal to 1-3 times the amount of any commission or money received from unlicensed activities.

This shows why it’s important that your LLC confirms and maintains its required occupational licenses before providing services or entering into contracts.
2. Penalties Of Not Having Municipal Licenses
If your LLC operates without a required city or county business license, it may face municipal penalties that vary by location.
Example: In Knox County, operating without the required municipal license can result in the following penalties under Knox County Code of Ordinances § 12-36:
- Civil penalty: A fine of up to $500 (per offense).
- Daily accrual: Each daily violation is treated as a separate offense. This means that fines can accumulate daily until the issue is resolved.

In addition, LLCs may also face state-level tax penalties, administered by the county clerk for business tax registration or renewal violations.
Example: In Knox County, the consequences may include:
- Delinquency penalty: 5% charge of the unpaid tax per month (up to a maximum of 25%). This happens when a license relating to business tax filings is NOT renewed.
- Returned payment fee: A statutory $20,00 fee applies to payments between $20,00 and $2,000. Alternatively, a 1% fee for amounts over $2,000 (if a payment is NOT processed).
- Interest: Delinquent amounts accrue interest at the state-set rate (11.50% for 2025).
What About Federal Business Licenses?
Most LLCs in Tennessee do not need a federal business license or permit, but one is required if you operate in a federally regulated industry. Violating federal regulations makes your LLC face serious financial and legal consequences.

Furthermore, you still must meet two foundational federal obligations if your LLC’s activities are NOT listed on the table:
- Obtain your Employer Identification Number (EIN) from the Internal Revenue Service (IRS).
- File your federal taxes once a year as required by law.
