There’s NO general business license requirement in Maryland. Because of this, your license requirements depend mainly on your operating location and chosen activities.

A Detailed Overview Of The Maryland Business Licenses

Acquiring your business license in Maryland ensures that you can legally operate in your chosen industry and location. Licenses are issued by the state, local city/county, or federal government.

So, business licenses normally fall into two main categories.

  • General business licenses are needed for most LLCs at the state level, regardless of their location or industry.
  • Occupational licenses are only required for certain professions like trades and regulated industries.

There’s no one-size-fits-all business license for an LLC in Maryland. To get your necessary licenses, you’ll have to apply using the relevant local, state, and federal licensing agencies. More about this below.

1. Maryland State General Business License

As mentioned, there’s no state-level general business license requirement in Maryland.

But depending on the exact type of business you run, your LLC might still need to get an occupational license.

2. Maryland Occupational License

Before doing business in the state, you’ll need any required occupational licenses if operating in a regulated industry.

Start with the Maryland Department of Labor’s licensing resources and online licensing directory to check your licensing needs.

The Maryland Comptroller issues certain licenses and actually has a list of licensed business activities that you can look up. Try contacting them or the Department of Labor if you need further guidance.

Note: The Department of Assessments and Taxation doesn’t issue business licenses. Their primary focus is on the Articles of Organization and any related issues.

Maryland Municipal Business Licenses

Any local business license needs, also known as municipal licenses, depend on your chosen operating location.

These are divided into two categories. You have general business licenses and industry-specific ones.

Some businesses may not need any license at all. Contact the Circuit Court clerk to see what’s needed. They handle all local business licenses in Maryland.

How Much Is A Business License In Maryland?

There is no need for a general state business license in Maryland. Because of this, you don’t have a standard state licensing fee.

Even so, you’ll likely need state occupational licenses and/or local permits, based on what you do and where you do it. To make things complicated, each one incurs costs at different levels.

For instance, license costs in rural areas are generally cheaper than in heavily populated counties with large cities. If I take a highly regulated industry like childcare, it usually incurs steeper fees compared to standard businesses.

What I’m basically saying here is that I can’t predict or even estimate your exact licensing costs.

Some are free, while others cost from $50 to over $1,000, plus renewal fees. I highly recommend checking with the necessary licensing agencies for current fees and requirements.

Maryland Sales and Use Tax License

You must obtain a Sales and Use Tax License from the Maryland Comptroller under the Maryland Statutes §11–702 if you sell tangible personal property in the state.

Note: This applies regardless of whether you sell online or in a physical Maryland location.

Do I Need A Business License In Maryland?

Operating without a license in Maryland is illegal. Skip this step, and you open yourself up to serious consequences. Below are a few examples.

1. State-Level Penalties

Penalties vary depending on the type of industry.

Let’s say that you work in the real estate industry. You’ll need to obtain a license before operating under the Maryland Statutes §16–706.

If you don’t, you’ll be found guilty of a misdemeanor, meaning you’re subject to a fine up to $5000, imprisonment up to 1 year, or both.

On top of this, the Commission can impose a civil penalty of up to $5000 per violation.

2. Municipal-Level Penalties

You can also face penalties from local governments if you fail to comply with their specific rules. Because cities and counties hold their own jurisdiction, local requirements and fines vary wildly from one corner of Maryland to the next.

Let’s look at how this plays out in real life. Operating inside the city limits of Baltimore means you are going to need a local city-level business license. Under the Baltimore City Code §17-42 and §17-44, ignoring this rule means you will be found guilty of a misdemeanor.

Getting hit with a conviction can land you up to 1 year in jail, a fine anywhere between $500 to $1,100, or both. You could also get slapped with a separate $550 penalty, and the city might even revoke your license entirely under certain conditions. None of this is a good look if you want to keep your business running smoothly.

Do You Need To Get Federal Business Licenses?

Don’t worry about acquiring a federal license unless you actually operate in a highly regulated industry such as agriculture, aviation, or firearms.

Most LLCs do NOT need a federal business license.

I suggest checking out the SBA Licenses and Permits page. You’ll find a detailed overview of the various federally regulated industries, including their guidelines and requirements.

Even without needing a federal business license, you still have two main federal requirements.

  1. Acquire your Employer Identification Number (EIN) from the Internal Revenue Service (IRS) for federal tax reporting.
  2. You’ll have to file and pay any necessary federal taxes.
