Maine Business Licenses Overview
A Maine business license is an official authorization allowing your LLC to legally operate in a certain industry or location.
Maine business licenses fall into 3 main licensing categories:
- State-level: These are issued by state agencies.
- Local-level: These are issued by county or city agencies.
- Federal-level: These are issued by federal agencies and apply to highly regulated industries such as aviation and firearms.
Furthermore, your Maine business licenses fall into 2 main categories:
- General business licenses mean every LLC must get it, regardless of location and industry.
- You may need to obtain occupational licenses if your LLC operates in regulated industry.
Important: There is NO general business license requirement for LLCs operating in the state. This means that your licensing requirements are determined by your business activities and location.
To obtain your necessary Maine business licenses, you need to apply to the relevant licensing or regulatory agency.
With each licensing agency setting its own rules regarding schedules, fees, registration, and renewals, the timeframe and total costs can vary widely.

Here, I’ll explain how to obtain each type of business license within the state of Maine.
1. Maine State General Business License
One of the main benefits of operating your LLC in Maine is that the state does NOT require you to obtain a general business license to do business in the state.
However, you may need to obtain an occupational license, also known as an industry-specific license, depending on what type of business you run.
2. Maine Occupational License
If you’re operating in a regulated industry, your LLC will need to obtain the necessary licenses before conducting business in Maine. These are commonly referred to as “occupational licenses.”
I recommend reading the “How to Get a Business License” page provided by the Maine government to check whether your LLC needs to obtain an occupational license or permit. You can also find contact details of each agency that you may need to contact regarding your licensing applications.
Furthermore, check the list of resources by profession to see if your chosen business industry or occupation requires a Maine business license.
Alternatively, you can check your business license requirements by using a service called Business Answers. This tool was created by the Maine Department of Economic and Community Development to help you start your business in the state. You can check your requirements by selecting your business type from a list or searching using keywords.
You can also contact the Business Answers service to ask questions directly.

Maine Municipal Business Licenses
Maine municipal business licenses are issued by cities, towns, counties, townships, and boroughs. To keep things simple, I collectively refer to these as “municipalities.”
You have two main types of municipal business licenses:
- General business licenses.
- Industry-specific licenses.
Your Maine licensing requirements depend on where your business operates.
If your LLC is based in a city or county that requires a general local license, you’ll need to get one. On top of that, some areas also require industry-specific licenses depending on what your business actually does.
That said, not every business needs a license. Certain activities, like making homemade goods or offering consulting services, may not require one at all.
Contact your municipality to check your local licensing requirements:
- 2026 Directory of Maine Counties provided by the Maine County Commissioners Association (MCCA).
- Search Google for your town or city’s website.
How Much Is A Business License In Maine?
There is NO general business license requirement in Maine. Therefore, you do NOT need to pay any state-level fees to obtain a Maine general license.
That said, your business may still need other licenses before you can fully operate. This can include state-level occupational licenses or permits issued by your city or county, depending on what you do and where you’re located.
Because of that, your total licensing costs come down to your specific business activities and your operating location.
Note: Every licensing agency has a different fee schedule. Therefore, I can NOT give you exact licensing costs.
In most cases, you can expect to pay between $50 to over $1,000, with some licenses requiring yearly renewal fees from $25 to several hundred dollars to keep them active.
If your business doesn’t require any state occupational licenses or local permits, you may not have to pay any licensing fees at all. In that case, your Maine business license cost could be $0.
I highly suggest contacting your relevant licensing agencies above to determine your exact licensing costs.
Maine Sales Tax Account
You must register, collect, and remit Sales Tax under the Maine Statutes §1754-B if your LLC is located in Maine and conducts sales of tangible personal property or taxable services, regardless of whether you’re operating online or in a physical location.
To do this, you need to obtain a Sales Tax account from the Department of Administrative and Financial Services. This is also known as a registration number, Sales Tax account, retailer number, or reseller certificate.

Note: Setting up your Maine Sales Tax account is free, no matter which filing method you choose.
You can register your Sales Tax account with the Department of Administrative and Financial Services online through the Maine Tax Portal.
If you prefer to file by mail, you can also complete and submit the Business Registration Form.
Once your application has been approved, you should get your Sales Tax number within 1-2 days if you’re applying online. If you file by mail, you need to wait much longer (several weeks). In this case, you’ll be sent a letter via mail containing your paper Reseller Certificate within 20 business days.

Why Is It So Important To Get Your Maine Business Licenses?
You can’t legally operate in Maine without the required licenses for your business.
If you skip this step, you’re opening yourself up to real consequences. That can include civil penalties and, in some cases, even criminal charges.
1. State-Level Penalties
Your Maine business license requirements depend on what your business does and where it operates.
Because of that, penalties aren’t one-size-fits-all. They can vary depending on the type of license you need and the specific rules you didn’t follow.
Let’s say your business is involved in selling alcohol. According to the Maine Statutes §2078, you’re committing a Class E crime by attempting to sell alcohol within the state without a valid license.
You can review the possible penalties you may face in this table:
| Offense | Monetary penalties | Jail time |
|---|---|---|
| First offense | $300 to $500 (plus costs) | Up to 30 days |
| Second offense | $500 to $1,000 (plus costs) | Up to 60 days |
| Further offenses | Minimum $1,000 (plus costs) | At least 60 days + up to 4 months |

2. Municipal-Level Penalties
The same idea applies to municipal licenses.
Each city or county has its own rules, and the penalties depend on the local requirements you didn’t follow. What might be a minor issue in one area could be treated more seriously in another.
Also, these are separate from state-level penalties. That means you can be fined or penalized by both the state and the local authority at the same time.
For example, if you’re operating in Portland, you need to get a city business license before starting any business activities.
Under Portland City Code 18.18.030, running a business without that license can lead to several penalties.
- Civil penalties may reach up to $5,000 per violation.
- If your violation isn’t fixed within 30 days, you may need to pay monthly enforcement fees.
- Your monthly fees can double if the issue is still unresolved after 6 months.
- A lien may be placed on your property by the state. You will then continue to be charged until the issue is fully resolved.

Do You Need To Get Federal Business Licenses?
You only need a federal license if you operate in highly regulated industries, such as agriculture, aviation, and firearms. Because of this, most LLCs do NOT require a federal business license.
I highly recommend checking the SBA Licenses and Permits page to find out your federal licensing requirements. The page will provide an overview of the different federally regulated industries, as well as their guidelines and requirements.
In the table below, I’ve listed the common federally regulated industries alongside the respective issuing agencies. I advise using this as a good reference point when working out your licensing needs.
| Business activity | Issuing agency |
|---|---|
| Agriculture | U.S. Department of Agriculture (USDA) |
| Alcoholic Beverages | Alcohol and Tobacco Tax and Trade Bureau (TTB) |
| Aviation | Federal Aviation Administration (FAA) |
| Firearms, Ammunition, and Explosives | Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) |
| Fish and Wildlife | U.S. Fish and Wildlife Service (FWS) |
| Commercial Fisheries | National Oceanic and Atmospheric Administration (NOAA) Fisheries Service |
| Maritime Transportation | Federal Maritime Commission (FMC) |
| Mining and Drilling | Bureau of Safety and Environmental Enforcement (BSEE) |
| Nuclear Energy | U.S. Nuclear Regulatory Commission (NRC) |
| Radio and Television Broadcasting | Federal Communications Commission (FCC) |
| Transportation and Logistics | U.S. Department of Transportation (DOT) |
You still have two main requirements if your LLC is NOT required to obtain a federal business license:
- You must obtain your Employer Identification Number (EIN) for federal tax reporting from the Internal Revenue Service (IRS).
- You also need to file and pay any required federal taxes.

Frequently Asked Questions
No, the Maine Secretary of State does NOT deal with business licensing requirements. They mainly manage your business entity formation and registration procedures.
For example, depending on the business entity type, business owners file different paperwork with the Secretary of State to create their business entity.
If you need more information on your different licensing requirements and costs, I recommend contacting the specific licensing board or department and/or your local government agency.
Since you have NO general business license requirement, there is NO single statewide Maine business cost for your LLC.
Your licensing requirements primarily depend on your operating location and industry.
With each business being unique, I can’t give you an exact estimate. You can contact relevant licensing agencies to confirm whether or not you need to pay any registration and renewal costs.
No, an LLC is NOT the same thing as a business license. They’re completely different things.
An LLC is a type of business structure created once you’ve filed your formation documents with the necessary state government. A business license is a document authorizing an individual or company to conduct business in the state. It does NOT create an LLC.
You’ll need a Maine business license if your LLC is involved in certain activities or operates in a location that requires one.
The best way to confirm is to contact the relevant state or local licensing agency. They can tell you exactly whether your business needs a license based on what you do and where you’re operating.
