Louisiana Business License Requirements Overview

A Louisiana business license is an official authorization that allows your LLC to legally operate in a certain location or industry.

Louisiana licenses generally fall under 3 main licensing jurisdictions:

  • State-level: Issued by state agencies.
  • Local-level: Issued by parish or city agencies.
  • Federal-level: Issued by federal agencies. These apply to highly regulated industries such as aviation and firearms.

Louisiana business licenses also fall into 2 main categories:

  • General business licenses means every LLCs must get it, regardless of location and industry.
  • If you operate in regulated industries, you’ll need to secure occupational licenses, a.k.a. industry-specific business licenses.

Important: Louisiana has NO general business license requirement for LLCs operating in the state. Because of this, your requirements depend on your operating industry and location.

How To Get A Business License In Louisiana

You have two types of state-level business licenses:

  1. General business license.
  2. Occupational business license.

Note: Remember, the state of Louisiana has NO general business license requirement.

Depending on the type of business you run, your LLC may need an occupational license.

1. Getting Started

To begin, go to the geauxBIZ portal. Then, click “Sign in or Create Account.”

You need an account to log in and create a checklist. Create one now if you don’t already have an account.

2. Setting Up

Once you’re logged in, click “Create a Business License Checklist” from the Quick Links section on your main dashboard.

3. State Your Business Information

Next, enter your full legal name (first name and last name) and mailing address.

Work your way down the list by selecting your “Sector”, then “Subsector”, and continue as prompted.

Tip: If you don’t know your suitable NAICS code, use the North American Industry Classification System (NAICS) site to search for different business industries.

Following this, choose your parish and location. Then, use the “Yes” or “No” boxes to determine if you’re operating “Inside City Limits.”

Click “Submit Request” once everything is complete.

4. Review Your Checklist

On the review page, you can view or download a PDF that lists the main agencies and departments that may need to be contacted.

You should then contact the relevant board or licensing agency if you have any further questions regarding a specific license.

Note: Your PDF checklist should say “An assumed business name must be registered with” and then give the phone number of your local parish clerk of court. You can ignore this statement because it is misleading.

You do NOT need to register an assumed business name if you formed a Louisiana LLC and operate under the same name. You only need to do this if you’re operating under a name different from your official LLC name.

Municipal Business Licenses

Municipal business licenses are issued by cities, towns, counties, parishes, townships, or boroughs. I’ve collectively referred to these as “municipalities” to keep things simple.

The municipal business licenses can be divided into 2 main categories:

  1. General business licenses.
  2. Occupational business licenses.

If your municipality requires you to obtain a general business license, you need to obtain it, regardless of your operating location or business activities. This requirement also applies to the occupational licenses, with requirements based on your chosen business industry.

Example: I want to open a place that sells alcohol in St. John Parish. In this case, I would need to contact the St. John Parish Clerk of Court to obtain my occupational license.

To determine your business licensing needs, you should contact your municipal agency. I’ve provided some helpful contact points below:

How Much Is A Business License In Louisiana?

The state of Louisiana does NOT have a general business license requirement. Therefore, you do NOT need to pay a fee at the state level for a general license in Louisiana.

Despite this, you may need to obtain state-level occupational licenses or municipal-level licenses/permits before operating in the state. Your licensing fees depend on your operating location and chosen business industry.

Note: Each licensing agency has a different fee schedule. Therefore, I can NOT provide your exact licensing costs.

Generally speaking, Louisiana licensing fees range from $50 to over $1,000, depending on your required license types. Alongside this, some licenses require renewal fees to keep them active. These range from $25 to several hundred dollars.

I recommend contacting your relevant licensing agencies to determine your licensing costs using my above resources.

Note: Some Louisiana LLCs may have a total licensing cost of $0. This is the case when they require NO licenses to legally operate.

The Louisiana Sales Tax Certificate

Under the Louisiana Revised Statutes (RS) 47:301(4), you qualify as a “dealer” if your LLC uses, consumes, stores, leases, sells at retail, or rents taxable property, or provides taxable services in Louisiana.

If this is the case, you’re required to collect and remit Sales Tax under the Louisiana Department of Revenue (DOR) requirements. You must first obtain a Sales Tax Certificate to do this legally.

Your Louisiana Sales Tax Certificate is free to obtain, regardless of your chosen filing method.

You can get your Sales Tax Certificate through three main application methods:

  • Online via geauxBIZ: This can be done with the same application portal used to file your Articles of Organization and Initial Report documents. You can register your LLC and obtain your Sales Tax Certificate.
  • Online via LaTAP: Register your LLC and obtain your Sales Tax Certificate via LaTAP with the DOR.
  • By mail using the Application for Louisiana Revenue Account Number form (Form CR-1): This also registers your LLC and allows you to obtain your Sales Tax Certificate with DOR.

Your filing should be processed in 3-5 business days if you use the online method. Mail filings take up to 3 weeks to process.

Why Is It Important To Obtain Your Louisiana Business Licenses?

You must obtain your required Louisiana business licenses before officially conducting full business operations in the state. If you don’t, you risk facing civil penalties and potential criminal offenses. I’ve discussed some of the main potential penalties in the sections below.

1. State-Level Penalties

There are several potential penalties if you operate without obtaining your required business licenses in Louisiana. Your penalties depend on your chosen operating industry.

Let’s say I want to open an LLC that sells alcoholic beverages. I can NOT engage in manufacturing, supplying, or dealing in alcoholic beverages without first obtaining the required permits under Louisiana RS §26:75. Each day I operate is considered to be a separate violation.

These penalties are set under Louisiana RS §26:171. They may include a criminal fine of $100 to $500 and or imprisonment for 30 days to 6 months.

2. Municipal-Level Penalties

Alongside potential state penalties, you may also face municipal penalties.

Example: You must obtain an occupational license in St. Tammany Parish.

Under St. Tammany Parish Code of Ordinances Sec. 22-5, you’re considered to be committing a “misdemeanor” if you operate without an occupational license. If convicted, you may be fined up to $200 per day for each day the violation continues, imprisoned for up to 30 days, or both.

Federal Business License Requirements

A federal license is only required for highly regulated industries such as aviation, agriculture, and firearms. Therefore, your Louisiana LLC will NOT need a federal business license in most cases.

You must meet 2 main federal requirements if your LLC doesn’t require a federal business license:

  1. Obtain an Employer Identification Number (EIN) from the Internal Revenue Service (IRS) for federal tax reporting.
  2. File and pay any required federal taxes.
