Once you obtain your business license in Hawaii, you’re legally authorized to operate in a specific location or industry.

Hawaii has three distinct levels of business licensing:

  1. State licensing: Licenses are issued by state agencies.
  2. Municipal licensing: Licenses are issued by cities or counties.

Generally speaking, your Hawaii LLC should fall into one of these two main categories:

You must apply to the correct regulatory and licensing agencies to obtain your required Hawaii business licenses. The relevant agencies depend on your operating location and specific business activities.

2. How Much Do Business Licenses In Hawaii Cost?

Your Hawaii business license fees depend on your license type. Generally speaking, license fees go from $50 to over $1,000. Your renewal fees range from $25 to several hundred dollars.

Some businesses don’t require any licenses. If this is the case, your total licensing fee is $0.

As I’ve stated above, state-level business licenses can be placed in two main categories:

  1. General licenses: These apply to your LLC regardless of your operating industry.
  2. Occupational licenses: These are required for LLCs engaging in regulated activities and professions.

1. Hawaii State General Business License

There is NO general business license requirement in Hawaii. Therefore, your LLC has NO application or renewal requirements. However, your LLC must obtain state-level occupational licenses if you operate in a regulated profession or industry.

2. State Occupational Licenses

State occupational licenses are permits required for LLCs engaging in certain business activities and professions. These may also be referred to as professional licenses.

Example: You must obtain the appropriate license from the Hawaii Department of Agriculture if your LLC business activities include importing plants, animals, or microorganisms into Hawaii.

Hawaii Municipal Business License

Hawaii municipal business licenses are issued by cities, towns, counties, parishes, townships, and boroughs. To keep things simple, I’ve collectively referred to these as “municipalities.”

There are two main license types:

  1. General business licenses.
  2. Industry-specific licenses. 

All businesses operating in a municipality must have a license if the municipality has a general business license requirement. This is regardless of their chosen business activities.

Alongside this, if your municipality issues industry-specific licenses, you need to obtain a permit based on your business activities. This is in addition to required zoning approvals, which are based on your business location.

Hawaii Business Tax Registration

Anyone receiving income from performing activities in the state must register for a General Excise Tax (GET) License.

You must first register your business with the Hawaii Department of Taxation and obtain a Hawaii Tax Identification Number.

I recommend filing your form online via the Hawaii Tax Online page to get it processed within 5–7 days. You can also use the mail-in option by completing the Hawaii Form BB-1 (Basic Business Application). However, this takes 4–6 weeks to process.

The Importance Of Obtaining Your Hawaii Business Licenses

If you attempt to operate without a required license or fail to renew it on time, your Hawaii LLC faces penalties at the local and state levels.

1. State-Level Penalties

Your LLC faces several state-level consequences for operating without the required business licenses.

Example: Under HRS §436B-26.5, a person or business engaging in professional or vocational activities without the required licenses faces citations and civil penalties. These may include penalties of:

  • First violation: Up to $500 (or 40% of the value of services).
  • Second violation: Up to $1,000.
  • Subsequent violations: Up to $5,000.

2. Local-Level Penalties

All LLCs operating in a certain locality are required to obtain a business license from their local agencies. For example, it’s unlawful for any person to peddle in a public place without a peddler’s license issued by the city under the Honolulu Code of Ordinances § 13-6.2.

Under the Honolulu Code of Ordinances § 13-6.4, the penalties for this violation are:

  • First violation: A $100 fine.
  • Second violation: A $250 fine.
  • Third or later violation: A $500–$1,000 fine, up to 30 days in jail, or both.

Federal Business License

Most LLCs operating in Hawaii do NOT need a federal business license or permit. However, you will need one if you operate in a federally regulated industry.

Your LLC still needs to meet two main federal requirements if your LLC’s activities are NOT listed in my table above:

  1. Acquire your EIN from the Internal Revenue Service (IRS).
  2. File your federal taxes once a year (as required by law).
