Why Do You Need The Arkansas Business Licenses?

Arkansas does NOT have a statewide general business license. Therefore, the penalties for operating without the required licenses come from municipal rules and professional/occupational regulations. Each authority level may impose different enforcement actions and fines, depending on the violation.

1. Municipal License Penalties

Local cities and counties in Arkansas may penalize LLCs operating without the necessary local permits. While each municipality may enforce its own rules, the state sets the maximum penalty limits.

For example, in Hot Springs, these are the maximum business fines set under Arkansas Code § 14-55-504:

  • $1,000 for a first offense.
  • $2,000 for a second offense.
  • $4,000 for each subsequent offense.

Furthermore, each subsequent violation day is treated as a separate offence, meaning daily fines may accumulate. This is often used to punish businesses operating without the required local business licenses, municipal permits, and zoning approval.

2. Occupational License Penalties

Professional and occupational licenses are regulated at the state level. Different licensing boards determine the penalties for operating without the required licenses. State law offers an example of how strict the penalties can be.

Example: Contractors performing construction work without a contractor’s license can be fined:

  • $100 to $400 per unlicensed activity day.
  • Up to 3% of the total project value as a maximum cumulative penalty.
  • A six-month license suspension or license refusal for repeat offenses.
  • Potential legal action to collect unpaid taxes.
  • Orders to stop the unlicensed activity.

The Arkansas Sales And Use Tax Permit
