Because of this, it’s so important that you maintain a reliable business address where these vital documents and notices can be received and correctly processed, something which is expressly stated in A.C.A. § 4-38-119.
Beyond this, having a professional Registered Agent protects your personal details. This is because their address appears on the Arkansas Public Business Database instead of yours. If you list yourself, your personal details become part of the public record; anyone can look you up and use your address. A default judgment may be used when a party “fails to appear or otherwise defend” after being served with the official legal notices. This is set out under the Rules of Civil Procedure, Rule 55. Once a default judgment is entered, the court can proceed without further notice.

If you miss one delivery, it can be treated as properly served, even if you never received it.
